@coldsiren, since your sister petition you and your sibling. You're all F4 Category and I think they are processing PD Year '88. That approval on 2009 is the NOA 2. USCIS move your papers to NVC but they (NVC) has to wait until your PD will be current. I know it sucks...

Let's all pray that the VB will go faster on March. :)

RE: F4 category

4 years ago may nakasabayan akong family sa medical exam at st. luke's... ang wife ang beneficiary so chikahan kami konti..  ;D kasama hubby & 3 kids niya.. it took 23 years for their PD to be current so tagal din nilang naghintay ano.. kaya nga sabi ko mas maganda na may hinihintay ka keysa wala..  :D my motto in life..  ;D for the kids future daw which is true...  8)

^You're welcome! ;)

Mga sis, APPROVE na sila!!! Yipeee!!! ;D He he he  We're so happy. One lang question sa mama ko and it wasn't really even a question. The CO just said that her blouse looks like the flag of TN. Most of the question were asked sa papa ko. They asked how many children do they have? How many are in the states? Where will they stay when they arrive here.

Tapos, the CO said Congratulations!!! You are APPROVE. Welcome to the US! ;D Sabay shake hands. LOL! Kahit may glass divider, shake hands sila...

Waiting nalang for the delivery of their visa. And then preparation nila before coming here. ;D Papa wants it maybe on April sila lipad daw dito.

Yeeeyyyyyy!!! I wanna dance..... LOL! ;D

sis lyn am sooo happy for you. You are a big help to us all sis. congrats.

Hello po sa mga Sisses!

@lyn, congrats sayo Sis.

LPR ang hubby ko, we are about to file for F2A, need po ba i-file ng separate I-130 ang 3yr old daughter namin? But in case na maabutan ng citizenship nya ang F2A application namin, thats the time that we need to file a separate I-130 for my daughter?? Tama po ba yun?

FAQs:

Q: I was petitioned by a relative several years ago, but my petitioner has moved back to the Philippines. Can I still immigrate to the United States?
U.S. immigration law requires that petitioners be domiciled or reside in the United States. The purpose of family-sponsored immigrant visas is to reunite family members. For more information on this issue, please see the section on What is the U.S. Domicile Requirement For Petitioners?.

Q: I was a Lawful Permanent Resident ("Green Card" holder) who left the United States for several years. Can I still return to the United States using my Green Card?
As a Lawful Permanent Resident you may remain outside the United States for only one year unless you receive a re-entry permit from the U.S. Citizenship and Immigration Services before your departure from the United States. Otherwise, you are considered to have forfeited your status and must either be re-petitioned or apply for a Returning Resident Visa. The returning resident visa is granted only when circumstances beyond your control prevented you from returning to your U.S. domicile within the required period of time.

if your h2b plans to stay in the Philippines for 6 months to 1 year then he needs to obtain a Re-entry Permit before leaving the US.

somehow that helps sis...  :)

Welcome sis ato...  :)

wag ka na malungkot ok sis.. F1 category ba si h2b mo? i was petitioned din under F1 category but since gusto ko kasama si hubby and anak ko pag-alis ko nagpakasal kami so F3 category na ako ngayon... (with the same PD when i was still in F1)  :) although im aware na mas matagal ang waiting time ng F3 kumpara sa F1.. i don't mind at all even if i have to wait more years bec for me sila ang importante and not sa tagal ng time na hihintayin ko...hehe!  ;)

you can check also sis the VB for F1 and F3 category so ma compare ninyo... kung ayaw mo talaga magkalayo kayo ng matagal you have the options naman sis...  :)

cheers!  ;)

sis ato, Thanks. About your q: When he (your h2b) gets the re-entry permits it's the USCIS discrection if they will grant it or not. But usually naman they do.

I just want to share this too. A friend of a friend of mine has a re-entry permit who went back to PI and stay there for a year. When she return sa US she was detain for a lot of questioning, she barely made it out of the office. But at least she got out. US immigration frown upon on that. For you to be able to granted re-entry kailangan may valid reason. And it's the discretion also of the immgration officer at the POE if he/she deem it valid reason. Yung reason nya why she has to stay sa PI for a year because she needs to finished her course kasi 1 year nalang daw kulang at sayang daw if she didn't finished it.

But wag malungkot sis. God will always make a way. ;) Kahit impossible na, He will make it very possible. :D

Like what sis kuruga said, pwede kayong magpakasal make a baby, have a life moving forward while waiting for your petition. But once okay na petition, kayong lahat magkakasama lumipad. :)

Best to write down ano ang mas priority ninyo.

-Getting married and have a baby while waiting together with your petitions.
-Or wait, let your h2b come here in US and go back there to marry you and get you.

And yes sis, he needs to go back sa states to file a petition for you. Only a US citizen kasi can file a Direct Consular Filing, and this is faster than filing in a Service Centers.

Here's an info about DCF (Direct Consular Filing):
http://www.visajourney.com/content/dcf

But since LPR lang cya, he will file it the usual way and one of the requirement are US domicile. So he can't stay with you for long after the wedding... :( Sorry...

Well, I guess he could if he got the re-entry permit but if his reason why he stayed for long in the PI is that he got married and doesn't want to leave you to go back sa states. He is telling the US that he has more ties in the Philippines than the US and it will look like he doesn't intend to go back to the US.

Quote
In order to qualify as a returning resident, individuals must apply at the U.S. Embassy to demonstrate to a consular officer that they departed the U.S. with the intention of returning after a stay of less than one (1) year abroad, and their failure to return to the U.S. as planned must be shown to have been for reasons beyond the individual's control.

@sis ysella, Thanks sis. About your q: No sis, no need to file a separate petition sa baby mo. Like you said your baby is included as derivative.

But when your hubby change from LPR to USC that's when you need to file a separate petition. :)

^*blush* you're welcome sis. I'm glad I could help...GT's been a great help to me too.... so pass it on... ;)

sis ato, pahabol...basta take note sis kailangan yung mother (the petitioner) is a US citizen if ever you and your h2b do get married. That way di ma vo-void petition nya and his mother can just change his category. Also kailangan the petitioner can call the NVC before they made a decision. Because any decision made before na change category nya, it was made bec NVC thought single pa cya...and ma vo-void yung petition.

Good luck sis. ;)

F1 category:

Visa Bulletin Feb2011

01AUG94

sori kung makulit ha, pero gusto ko lang talaga maging clear lahat.. so i need to ask him (bf) kung kelan priority date ng petition nya? then kung before 01AUG94 ang priority date ng petition ibig sabihin on going na yung process ng visa nya? tama po ba?

kasi the reason why i'm also asking this is because meron na po ako tourist visa, so we're just waiting for his visa para sabay kame punta ng US then after marelease yung papers nya papakasal na kame... un na lang talaga inaantay namen para magsettle down.. :(

Hi sisters! have you heard about diversity visa? ? Funny kasi, may nag email sakin from USAFIS that I have been selected to receive a visa from the US under the Green Card Lottery Program daw. Here's their email;

"We wish to notify you that you have been selected as one of the Diversity Visa (DV) Program winner for receiving a United States
Permanent Resident Card. It is also known as the Green Card Lottery. The lottery has been administered on an annual basis
by the Department of State and conducted under the terms of Section 203(c) of the Immigration and Nationality Act (INA).

Section 131 of the Immigration Act of 1990 (Pub. L. 101-649) amended INA 203 to provide for a new class of immigrants known
as "diversity immigrants" (DV immigrants).

As part of the agreement we will issue  A FREE Airline ticket from your country to the USA to claim your Green Card under
the American Green Card Lottery Program.
The ticket will be sent via post mail at your address registered with us once your visa
will be  remitted by the U.S department of State.

The U.S Department of State will should contact you soon with visa processing information and how to proceed further. "

Sounds cheesy eh?

I googled this diversity visa thingy, and to my surprise the website of bureau of consular affairs appeared.

http://travel.state.gov/visa/immigrants/types/types_1322.html

meron pala talaga BUT unfortunately, ineligible ang Philippines sa lottery na to, only those who has low rates of immigration to the United States ang pwede.

Sayang pero okay lang. Lol  ;D

yeah sis better ask your bf his PD.. if his PD is before 01AUG04 means hindi pa siya eligible for processing so he has to wait hanggang maging current PD niya..  :)
