How to get your ITR copy?

I've been a consultant for two consultancy firms. Kaya lang hindi ako mabigyan ng copy ng ITR ng parehong company. Nagdeduct sila 10% consultant tax every payroll. Pero since wala akong copy ng ITR ko, I don't know if both companies paid my taxes properly in BIR.

So to solve this dilemma, I would like to know if I, the employee, can go to BIR and request for a copy of my ITR for 2008 and 2009. Is this possible mga sis?

I don't know that much about ITR's, taxes, etc. but definitely I know that ITRs should be coming from the employers. Correct me if I am wrong, that's the Certificate of Tax Withheld di ba? Proof na nagdeduct and nagbayad sila for your taxes.

You can try to call BIR for assistance (although based sa experience ko, they are never phone-friendly people) or punta ka na lang dun, maybe it's better in person.

sis clermont as i understand it (correct me if I am wrong) consultant ka lang po - hindi ka regular employee nung company. kaya nga 10% tax lang ang wini-withheld or binabawas sa iyo - kasi yun ang tax from professional fees mo, at eto rin ang proof mo na binawasan ka nila ng tax at dapat na niremit nila sa BIR

If this is the case, talagang wala kang makukuhang ITR from the Company, ang dapat na binibigay lang ng company sa iyo ay BIR FORM 2307 - Certificate of Creditable Tax Withheld at Source , quarterly po eto, so on or before the 20th day of the following month after every quarter dapat may narereceive kang ganitong copy from the company (although mas madalas you should have the initiative to get it from them)

then at the end of the year or come filing of ITR , you should prepare, compute your own ITR, i-susummarize mo ang earnings mo for the year and then mag a-atach ka din ng copy ng BIR Form 2307 - para ibabawas na sa dapat mong bayarang yearly tax ang mga winitheld na sa iyong 10%., then ikaw mismo ang mag fi-file nito sa BIR.


And even if you would say na hired ka as regular employee of one company, since sabi mo 2 ang consultancy firms na nagbabayad sa iyo, then should your 1 company give you a copy of your BIR FORM 2316 Certificate of Compensation Payment/Tax Withheld (at the end of the year) as their regular employee, and the other company will give you BIR FORM 2307(quarterly) then its really your responsibility na i-consolidate yung mga yun , compute your earnings and should be tax then file your own ITR sa BIR.

^Naku po sis dimplesgon. I thought I don't have to file anything on a yearly basis because I'm a consultant (project-based) and this is my only source of income.

Unfortunately, I don't have any copies of the company's tax payment for me. I will contact my previous companies and asked them for BIR FORM 2307 - Certificate of Creditable Tax Withheld at Source. Thank you sis pumpkin13 and sis dimplesgon!

I-bubump ko na lang yung thread na ito dahil medyo magkalapit kami ng problema ni TS.

Nagtratrabaho kasi ako bilang research assistant para sa isang consultant ng isang consultancy firm, on a project-based basis. Kaya sa consultant ako napunta dahil yung na-award na project sa kanya bilang individual consultant at hindi doon sa firm. Alam ko na hindi ako tinatax, pero akala ko hindi naman nila yun gagawin kung bawal. Personal kasi, so parang binibigyan lang ako ng allowance/honorarium/professional fee? Pero ngayon, binabasa ko yung mga guidelines and regulations ng BIR and mukhang dapat nagbabayad rin ako ng tax.

So ang mga tanong ko ay:

1) Siguro sa self-employed category ako mabibilang (Hindi ako 'ganap' na employee so di pwede sakin ang Form 1702). Eligible ba ako sa Optional Standard Deduction? Or considered as pure compensation income pa ba yung sweldo ko?

2) Kung ngayon lang ako magbayad ng tax para sa buong taon (hindi ako nagbayad quarterly dahil again, hindi ko alam na kailangan), may penalty ba ako?

3) Yung first TIN ko, kinuha noong panahong kailangan pa ng TIN para makakuha ng driver's license. Kailangan ko bang ipa-cancel yun at gumawa ng bagong TIN?

4) Naglipat ako ng bahay at iba yung 'registered adress' ko at RDO (Revenue District Office). Kailangan ko pa bang baguhin yun sa BIR?

Hay. Kaya naungkat itong gulo na ito e mag-aapply sana kami ng pamilya ko ng tourist visa. Isa sa mga posibleng requirements, ITR. Kung hindi ko ito makuha in time, mukhang cross fingers na lang na hindi hanapin. Pero magbabayad na talaga ako mula ngayon. Mahirap pala i-asa ang tax sa ibang tao. :P

tanong ko din ito. i work on a freelance basis, output based  so kung walang pinagawa, walang sweldo. problem ko, pano ako mag file ng tax?  the company that i write for deduct 5% off the salary that  i receive. ang issue ko, hindi naman sila monthly magbayad tapos hindi rin consistent yung amount, depende kung magkano lang ibayad nila. they don't issue receipts din, they simply deposit my salary to my account.  i'd like to file for an ITR pero hindi ko alam kung pano and pano magcompute.

Sis mallorn, pareho tayo ng dilemma.  I worked on a research project with my professor pero as a "consultant", hindi ako employed ng school.  Pareho rin kami ng h2b ko but he already paid his taxes.  Ako hindi pa kasi di ko pa nakukuha complete sweldo ko.  I think as a consultant mo sya file, kasi di ka naman self-employed unless business mo yung research work.

Sabi ni H2b, if you're filing it as a consultant, you can use the optional standard deduction. 40% daw ang bawas nun so malaki-laki rin.  Tapos marami pa raw mga deductions. Actually yung h2b ko nga got a rebate pa.

mga sis, ask ko lang kung pwede ka ba humingi ng itr kahit hindi ka nagbabayad ng tax. empleyado naman ako ng isang company.

You are not an employee, hence, you have to file and pay your own taxes less any withholding tax/tax credit. Yes, you are eligible for OSD. OSD is optional in lieu of standard deductions. Your income is not pure compensation but you may fall under self employed category.

It will depend if you have tax due. If none, you may just pay compromise penalty of P200 per each return.

No, you can use your existing TIN. Actually, if you will get another TIN, it is criminally punishable under our Tax Laws.

Yes, if your registered address is different from the RDO where you are currently residing. You just need to file updates so you will not have wrong venue

YES. if you are under statutory minimum wage, you will still receive an ITR but there is no tax due

sis, file ka ng quarterly at annual ITR kahit walang income for a particular period. You can use the tax table to compute for your income tax or ask an assitance if you hate numbers/math  ;D

sis, may RDO na mahirap tumawag at madaming tiga dun na hindi friendly.. and worst pag pumunta ka dun, baka makakuha pa sa yo ng information at kasuhan ka pa ng tax evasion, issue tax assessment, etc. lalo pag nalaman nila na hindi ka nagfile for previous tax period.. lalo na ngayon na patapos ang taon at kung kulang sa quota ng collection ang RDO na napuntahan mo, lahat gagawin nila maka-collect lang because of attrition law

so ingat lang sa mga pupunta ng BIR at magdi-disclose ng information

question mga sis, ito naman ang case ko:

May 2010-May 2011, I worked for this company--project-based position lang. Fresh grad ako niyan so 10% ang tax withehld ko by then. Nung natapos yung 1 year project based position lumipat ako sa ibang company June 2011. Binigay ko sa kanila yung BIR Form 2307 ko na galing sa previous company ko. And I explained nga yung status ko sa previous company. Problem ko lang is hindi ko na-file yung ITR ko buong duration na nasa previous company ko ako. Ngayon, aalis na ako sa company ko ngayon, may makukuha kaya akong BIR Form 2316 from them? And ano dapat ko gawin? Thanks!

If you are hired as an employee dito sa company mo at nag wi-witheld sila sa monthly income mo ng tax based on your monthly salary...then yes, may makukuha ka na 2316 for the year 2011.

Kung nag file ka na ng resignation sa kanila, just talk with your HR if ano ang mga needed mo para ma process ang clearance mo at kasama na dun yung when mo matatanggap ang last pay mo (if meron pa) at yung bir form 2316 mo.

hello mga sis..i am also a consultant from december 2010 til now..kaso i wasn't able to file my quarterly itr..and i am planning to file for annual itr before april..the company to which i am presently connected regularly withhold 13% (10% professional fee plus 3% percentage tax fee) of my gross salary every 15th and 30th of the month..I have form 2316 with me, all intact..My question is, am i going to be penalized for not paying on quarterly basis?help please!thanks..

individual ka naman so ok lang na annually ka mag file.

you can only file for january 2011-december 2011 income - na ang deadline of filing is this april 15, 2012 - wala kang penalty dito

yung mga previous year late na if di ka nag file

Paano po ang ITR ng employee ng BPO company? I just started working May of 2011 and I dont know how it works. I badly need one because I need a credit card, and requirement kasi ang ITR. Pls help. Thank you :)

girls, if you're full-time employees, your employer is responsible for paying your tax. After payment, you should get a FOrm 2316 which is a certification that you have duly reported your income and paid your tax via your employer =D
