Si mama nakapagpatayo ng bahay bago sila maghiwalay ni papa, ngayon hiwalay na sila at ang bagong asawa ni papa ngayon ang nakatira sa bhay, bago sila maghiwalay dinig ko sinangla ni mama at papa ang bahay at LUpa at si bagong asawa niya ang nagtubos,
questions:
1.pwd ba ito mangyari na siya ang magtubos?
2.if ever hindi totoo na c 2nd wife ang nagtubos ng bahay may habol p ba ang mama ko sa property o kaming mga anak?

I'll try to answer this sis ha, IMO.

1. Pwede naman yata. Pero depende pa rin sa pinagsanglaan at sa parents mo. Kung pumayag naman ang pinagsanglaan na tubusin iyon at ganon din ang Parents mo (in writing) pwede mangyari iyon.

2. Is your Mom still alive at kasal ba sila ng Dad mo? If yes, kahit tubusin pa niya (nung kabit)  ang property ng paulit-ulit sa Parents mo pa rin iyan. If not, mai-inherit yan ng Dad mo, at eventually paghahati-hatian ninyo ng Dad at siblings mo.
Kung kasal naman sila (ng kabit) hindi ko na alam kung paano kasi parang medyo complicated na pag ganon.

Thanks for this thread.
We have a deed of donation notarized since 2005, how much penalty tax do you think will be imposed?
Title is in my mothers name and still alive, do you think the donation is valid, coz if we 3 siblings subdivide this now, nothing left to her?
And im paying the real property tax since 1977 up to present. If i want to get my share now, and pay the donation tax in bir, can i obliged my 2 other siblings to pay also? I mean since my mom cant pay the donation tax, we siblings should pay for it, and as expected, i will be the one to make abono first coz they have no money. What i want is, we will divide the donation tax and the real property tax i paid since 1977, since the property will be equally subdivided, so must be equally shared the expenses.
If they cant pay in money, can i just claim part of their share in the property? My problem is complicated, i may need a lawyer to help me with this? Anyone in knowledge of this matter , please kindly share some tips and advice.

i have a question, may property ang lolo ko under his name sa Mindoro. he is already dead and left no will. he has 4 children and pumayag na lahat na ibenta yung property. however, one of the children (my dad) is dead na rin. kami lang ng mom ko ang heirs nya and payag rin kami na ibenta ang property.

nilalakad ng isang tito ko now [textspeak!] estate tax ng lolo ko and biglang kinukulit nya kami ngayon ng mom ko kasi hinihingi raw ng BIR ang birth certificate ko (which I understand), land holdings certificate, certificate of residence and paperwork ng bahay namin here in manila (property declaration, tax clearance, etc) na pinundar ng parents ko na nakapangalan na sa akin ngayon. (nilipat na sa name ko [textspeak!] property after my dad died)

bakit kelangayn yun eh wala namang kinalaman [textspeak!] property sa manila sa property sa Mindoro since sariling pundar na yun ng parents ko at from the start, sa pangalan na nila yung bahay.

ano ba talaga ang process ng estate tax kung patay na ang isa sa mga heirs (my dad) and may heirs ring naiwan yung namatay na heir (kaming 2 ng mom ko)?

also, pwede pa rin ba kaming habulin ng BIR for estate tax ng property ng lolo ko na never naman nalipat sa name ng heirs nya? hindi kasi naming sinama yun nung inayos naming [textspeak!] estate tax ng dad ko since hindi naman sa pangalan ng dad ko yung property sa Mindoro.

hi, sana may makareply po..

Kasal ang bayaw ko sa una nya asawa at may 2 anak siya duon. As of now, may kani kaniya na sila buhay. Magkasama na ngayon bayaw at kapatid ko sa iisang bahay at may isa silang anak. May sarili house na yung kapatid ko but then gusto ng bayaw ko mag avail ng housing loan either thru pag-ibig or bank financing. My question is this: Automatic ba na may karapatan na ang asawa niya dun sa bahay na kukunin nya? Plano kasi, pag malaki na yung anak nilang dalawa, ililipat sa bata ang titulo para may maipamana naman kahit papano. Ayaw kasi namin dumating yung point na, may habulan ng property.

quick question lang:

this house is owned by my grandparents but they don't/can't pay the taxes anymore. kung magcocontribute ako and akuin yung obligation to pay the taxes, may right ba ko with this house? TIA
