salamat mga sis. ganyan din yung advice ni sis bankerII. kaya't eto ko super nangungulit sa developer. Di ko talaga mainitindihan bakit dineny nila yung request ng father ko to transfer the ownership to me. Di pa naman napirmahan ng father ko yung deed of sale kaya dapat pwede pa diba?

Yung deed of assignment ba kami kailangan magpagawa sa abogado? Sana nga sis maayos to...

make the transaction simple:
amend the condition " Upon full payment, Deed of Sale shall be issued in favor of
from: the BUYER
to   : Ms. rockyroad.

signed by Seller and Buyer.

^Bro, that is good too, assuming the seller is agreeable (since it is a novation of the contract). However, it may lead to some complications if the BIR will see the contract to sell. Baka kasi sabihin ng BIR  umiiwas sa payment of appropriate taxes.  Baka lang naman.  the end effect of the amendment and the deed of assignment, however, would be the same. 

In the deed of assignment, the Whereas Clauses and the main paragraphs should contain the background as well as the consideration of the assignment.

^to ratacutie, parang may nabanggit na ganyan yung seller na baka questionin daw sila ng BIR kapag may binago sa Contract to Sell. So kapag deed of assignment mas ok sa kanila? kailangan pa rin magbayad ng tax na parang deed of absolute sale kapag yun ang pinagawa namin?

Dami ko natutunan dito. Mangmang talaga ako pagdating sa mga ganyang bagay. Salamat in advance sa inyong lahat  ;D

Hi po, I have a question hope you can help.

My father died bago nya matransfer yung land titles nya samin. I understand the division should be 50% for my mom, and then the remaining 50% will have to be divided sa ming magkakapatid na 4 and my mom.  Someone from my siblings would want to buy our shares and we agreed naman, meron ba kayong template na maise-share wherein all of us will sign to agree na itatransfer na lang sa kanya yung titulo?

^^sis, ask the seller.  basta ba you pay the appropriate taxes and you state the consideration in the deed of assignment.  i dont think it should be a problem.

^sis, if the title is in the name of your dad, you have to settle his estate first.

Hello all,ganito kasi yan 7 yung kapatid ng father ko tapos less 1 yung isa namatay na tapos ei balak na namin asikasuhin yung share ng father ko kasi nga tumatanda na siya(yun palang namatay na brother niya pero hindi na hinahabol nung family yung share niya so binibigay na nung asawa't mga anak niya yung share sa father ko)..paano kung ayaw ibigay yung part niya and ayaw makipag-cooperate nung mga kapatid niya..hirap kasi ei gusto na namin makapagpatayo ng sariling bahay kahit maliit lang ei kaso yun nga may mga kumokontra..palagi na lang parinigan at palagi din kami nag-aaway2x ng mga tita ko...sana matulungan ninyo ko kung anong dapat kong gawin para matulungan ko ang tatay ko...TIA

Dumating na yung kinatatakutan ko, just got an e-mail from my sister na i-shesheriff na raw yung bahay namin ng inutangan namin.Ngayon ang questions ko ito:

1.Wala na ba talaga kaming laban against sa inutangan ng parents ko na ang ginawang collateral eh yung bahay namin?

*I tried to contact the inutangan last November to settle 1M kasi yun lang talaga kinaya kong ipunin just to save the house.Pero the inutangan is hindi pumayag kesyo lumaki na raw masyado yung utang namin etc etc ..

2.Talaga bang kaya nilang kunin yung house namin ng ganung ganun lang kahit naka pangalan naman yung title sa dad and mom ko ?

Help mga sis naman,hindi ko na kasi alam gagawin ko lalo na at milya milya ang layo ko sa kanila.I wanna save the house pero yun lang talaga ang kinaya ng powers ko. Ayoko gumive up, good location in makati yung bahay namin at lahat kami doon lumaki. Kaya ng hihinayang ako eh,tapos sa halagang 350k lang na utang nila bigla hahatakin yung bahay namin.Advice naman po.TIA.

your case is bereft of details.
both of your parents signed the mortgage?
was there a foreclosure proceedings?
just for your info :
Art. 158. The family home may be ... encumbered by the owner or owners thereof with the written consent of the person constituting the same, the latter's spouse, and a majority of the beneficiaries of legal age. In case of conflict, the court shall decide. 

was the interest not " excessive, unconscionable and therefore contrary to public morals"?

pag-usapan po ninyo ng creditor but if nothing happens,
I think court intervention is necessary.

hi mga fellow gtalkers, pls help and let me kn0w where i stand. My lolo has a property na pnagaawayan namin nang uncle ko. The property was named under his name and my grandpa. Hndi dapat ako kasali sa mga legitimate heirs, but my dad passed away before my lolo. Kaya napas0k name ko and my br0thr sa titulo nung pr0perty. My lolo died na rin living n0 last will and testament. Here c0mes my big pr0blem, knukuha na nit0ng uncle ko yung share nya includimg my lolo's share. He wants me to sign extrajudicial waiver para ma trnsfr n sa name nya. I refuse kasi i stil want 2 be part of the pr0perty dahl dun na ako lumaki, i have been living in that place since birth. Para sa akin isang remembrance na lang yun, kc maliit lang naman share ko. Lola is stil living and 4 living kids (1 dead whch is my dad) so 2 kami nang br0ther ko. Pr0blema kasi year 2001, nagkarun nang internal agreement na ibbgay n s kanya yan whch was made by my lola and my father's eldst bro. I believed i was force to sign with pr0mises fr0m them na hndi kami pababayaan, etc. Etc. Pina n0tarzd nla toh. Aftr 10years, i2 na, ililipat n nga sa pangalan nang uncle. Pero ayaw ko na, kc mga panguu2 [textspeak!] gnawa sa amin mag iina. N0w, he said he will sue, i have rcvd a letter fr0m his lawyer telng me to c0mply with my obligaton or else they wil have to sue me.  Questi0n, may kaso b talaga ako or pwde ko rn sya i c0unter sue? May ipaglalaban p b ako?

Hi! I have few questions regarding inherited land. Here's the scenario: My father died and left a land. There's just me, my brother (both of us are not minors), and  my mother. My questions:

1. Paano po ba ang hatian ng lupa sa aming tatlo?
2. May mga papeles ba akong dapat malaman para ma-prove ko na ako ay may minanang lupa? Wala kasing last will and testament ang aking father.
3. Kung gusto kong ibenta ang lupa, ano ang mga dapat kong tandaan?

If there are already discussions on my questions, pa-post na lang po dito para mabasa ko. I tried searching FN kaso parang wala akong makitang kapareho. Salamat!

Hi! Need your advice please.

Yung house and lot na tinitirahan namin ngayon is more or less 500 sq.m. Base sa kwento ng lola ko, since she was working in Manila before she retired, pag uwi nya dito sa province (1980s) nakapgpalagay na ng bakod yung kapit bahay namin. And around 2-3 meters yung urong nila ng bakod (binawasan yung gilid ng prop. namin) Kung titingnan kasi yung main structure ng bahay nila namin, maliit talaga yung lot nila, even my tita asked na bakit daw biglang lumawak yung lote nila sa kabila.

Plano namin parenovate yung bahay,
1. What's a better way para mabawi yung 2-3 meters na lot?
2. Kailangan ba namin magbigay ng pera sa neighbor namin, dahil masisira yung garahe at kwarto na pintayo nila sa part ng lote namin?

need some answers/advise please...

here's the situation: we have a parcel of land, wherein sa title apat na magkakapatid ang nakapangalan. Now 3 are deceased, and the child of one of the deceased wanted to sell his share. Can the child do that? What if the other legal heirs doesn't agree?

Please advise... If some families/squatters are being relocated into another place by the local municipality, each families will be given a separate lots which i believe they will have this so called "rights" to the property.. Then papatayuan na nila ng bahay, my questions are.. What will be their assurance na hindi na sila papaalisin ulit sa lugar na yun? Yung rights the tinatawag nila, is it like a land title na rin ba? And lastly, pwede bang ilipat or ibenta sa ibang tao yung rights na yun?

pag bentahan ng lupa and the title is in the name of the deceased father u need to execute an extrajudicial settlement of estate with absolute sale. me forms na downloadable sa net pero kailangan me publication yan required ng bir. plus all of the heirs must consent to the sale

Si mama nakapagpatayo ng bahay bago sila maghiwalay ni papa, ngayon hiwalay na sila at ang bagong asawa ni papa ngayon ang nakatira sa bhay, bago sila maghiwalay dinig ko sinangla ni mama at papa ang bahay at LUpa at si bagong asawa niya ang nagtubos,
questions:
1.pwd ba ito mangyari na siya ang magtubos?
2.if ever hindi totoo na c 2nd wife ang nagtubos ng bahay may habol p ba ang mama ko sa property o kaming mga anak?
