(I erroneously posted this in the other thread , dito na lang po kayo sumagot kung pwede) .Salamat mga sis.

Help po mga sis. Prior to our marriage  , meron po akong nabili na lot .It was already titled under my maiden name. Then, pinatayuan namin ng husband ko ng house thru a bank loan. Around 2 years after matayuan ng house , nawalan ng job asawa ko and I am the only one who parctically paid for the loan until mabayaran namin. Now , medyo nagkakalabuan kamin ng husband ko because he continued to be a bum. I want to know kung may right talaga maghabol ang asawa ko sa mga properties na naipundar ko. Aside from the house, may 2 cars din ako , lahat sa akin nakapangalan . We're still trying to work on our marriage pero ayoko pong maisahan ng asawa ko dahil talagang ako halos lahat nagpundar at naghirap kung anuman meron ako ngayon. Yung house ba talagang kalahati noon kanya, kahit wala naman siya halos naging contribution sa pagababayad.

another question, what if Deed of Donation na lang? pano yung process? i mean, can we ask a lawyer to make a copy of Deed of Donation for us? then have my lolo sign on it? then notary public? valid na ba pag ganito? then saka na yung transfer ng title. thanks again

ako rin po may question regarding sa house and lot na ni-purchase namin. nakapangalan sa husband ko yung bahay, 5 years to pay yun, 2 years and 2 months ok ang bayad. then just this jan. 2009 up to now di na kami nakabayad. yung husband ko kasi in-abandon na kami ng baby ko at hindi na nagpakita at nagpadala ng pera(seaman kasi sya). ngayon i asked help from my kuya. i told him na sana sya na ang magsalba at bumili ng bahay. bayaran nya lahat ng arrears tutal pag nabayaran na lahat yun, 2 years to pay na lang yung bahay. and kahit bayaran na lang nya ako ng kahit 300k para sa bahay. willing naman sya. kaso ang tanong ko, pwede ko bang ibenta yung bahay sa kanya kahit nakapangalan sa husband ko? i  tried na kasi everything para makausap yung husband ko kaso talagang pinagtataguan na ako eh. sobra na akong lubog sa utang and i need money na rin. nag-file na nga ako ng ra9262 case sa kanya pero i doubt kung sisisputin nya yung hearing.

hindi ko rin alam kung saan itatanong ito:

my parents house is nakasangla sa tao.naisangla ng 350k nakahulog naman sila noon at naistop din due to financial prob.and then hanggang sa umabot na sa 6 yrs ang utang at lumaki na sya sa 1.6 mil.ang collateral is the house.ang question ko, maaari ba kaming magloan sa PAG-IBIG? para mabayaran ang utang ? tapos sa PAG-IBIG na kami bali maghuhulog ? TIA.

Effective 1988:

Art. 158. The family home may be ... encumbered by the owner or owners thereof ( only) with the written consent of the ... majority of the beneficiaries of legal age (children). In case of conflict, the court shall decide.

mga 5/6 people ba yun?

Hindi na puede "upuan" the transfer of title whether due to Donation or Sale.  Registration must be done within a period from date of donation/sale.  (For sales, alam ko within 30 days.)

Best you clarify the above with the Registry of Deeds nearest you.

Of course, you can just sit on it... but the penalties are not "friendly.".

IF you had no pre-nup that expressly said your properties acquired before the marriage are yours... eh it is now part of your common pot. 

Ang ginagawa nga ng mga ayaw mag pre-nup, kasi it is a very sensitive matter for some... like Juday before she became Mrs. Agoncillo... she transferred properties to the names of her mother, and siblings. 

Kahit na walang ginawa ang husband mo but to sleep, kung wala kayong pre-nup that says ganito ang sharing nyo of the common marital pot if 1 of you does not contribute as much as the other does... hati pa rin kayo. 
That is the law, and nobody is above the law.  (Sorry, alam ko masama sa kalooban kasi you were the one working hard, tapos binigyan ka pa nang sama ng loob ng hubby mo.)

Talagang hindi mo mabenta ang property kung hindi nakapangalan sa yo.  Atchaka, kahit na in your and your husband's names.. pag nagbenta ang 1 sa inyo, kelangan naka sign din nang conforme sa Deed of Sale ang asawa.

Kung ako ang brother mo, being practical (kahit na gaano kita kamahal being my sister) -- hindi ako papasok sa ganyan.
 
Baka pag nabayaran na nya at lahat eh.. the bank will of course, release the TCT to your husband kasi sya lang ang nakapangalan doon.  (Pero kulitin mo bakit you are the legal wife eh hindi nalagay your name on the TCT).   Eto na, baka biglang sumipot your husband and he will claim the property, kasi nasa name nya ang TCT. 

Bottom-line --  ang papel lang ng brother mo eh financier with a claim after the bank;  kasi hindi mo nga mabenta ang property;  at hindi mo din masanla kasi nakapangalan sa husband mo.   As it is now, hindi puedeng maging owner ang brother mo, kahit na sya magpatuloy nang loan.

Nakakalungkot ang situation mo.  Please pray and do not lose hope that you will overcome this problem you have now.  Prayers work miracles, believe me.

^ nagawan ko na ng paraan ang problem ko! nakausap ko na ang husband ko at nakipag-cooperate naman na ibenta na ang bahay. nagpagawa kami ng SPA na giving me the rights to sell the house so ok na po ako dun. pinirmahan naman nya yung SPA. alam naman nya kasi lahat ng kasalanan nya at lahat ng pagkukulang nya kaya siguro pumayag na rin sya.

Thanks sis Aquacharly . One time, my husband and I discussed this issue. Sabi niya willing daw siya to sign a paper stating that he is waiving his right doon sa mga properties. I told him kasi that everything na pinaghihirapan ko is for our 2 kids . I am consulting a lawyer if a deed of donation is a better option para hindi naman offending . We are on a better relationship now, hindi na gaya ng dati na palaging nag aaway .I don't want to rock the boat just because he's  offended by this legalities ( kahit na sabihin niyang okay , kasi it will still mean  I am securing everything) .At the same time ,I want to have a  peace of mind na whatever happens, anak ko lang ang makikinabang. Baka pag nawala na ako, mag -asawa na lang siya bigla at makinabang ang ibang tao (the new wife) sa pinaghirapan ko.

mga sis i hope you can help me on this. Bumili kasi ang father ko ng condo 5 years ago. Ngayon di na niya natuloy ang paghuhulog kasi ngkaproblem siya financially. So to save the condo, ako na nagbayad nung remaining balance. Okay naman sa dad ko na i-transfer sa name ko yunf title. Question is pano yung process ng pagtratransfer? Sabi kasi nung developer ng unit mas maigi na kami daw ang magasikaso ng pagtratransfer para mas makamura sa taxes and other fees. Kung sila daw ang mag-aasikaso mapapamahal daw kami at kailangan nilang i-declare yung exact price nung unit.

Kapag deed of absolute sale pwede bang di i-declare yung exact price ng unit para mas makamura sa tax? Kapag deed of donation how much yung tax na kailngan bayaran? Kailangan ba talaga na lawyer ang magayos ng mga ito? or pwedeng ipaayos lang sa kakilala at ipanotarized na lang ang mga kailangan ipanotarize?

Since this involves a Contract to Sell, the buyer can merely request the seller's conformity to amend and insert a provision:

that upon full payment of the consideration, the seller shall execute a Deed of Absolute Sale in favor of (you)

yes, we do it in certain cases.
wala namang mawawala sa seller, it's all legal anyway.
for your part, you just want to avoid double expenses
( two transfers)

^sis sabi ng developer since na notarized na raw yung contract to sell hindi na pwedeng i-amend. grabeh ang hirap nila pakiusapan. sana may iba pang way to dahil ayaw na namin mgbayad ulit ng tax na pagkamahal mahal. ganoon ba talaga pagnotarize na di na pwedeng baguhin?

What is the purpose of notarization?

“Notarization converts a private document into a public document and renders the document admissible in court as evidence without need for further proof of its authenticity. A notarized document is entitled, by law, to full faith and credit upon its face. Notarization also vests upon the document the presumption of regularity unless it is impugned by strong, complete and conclusive proof”

If the parties want to amend the conditions, so be it!
after all, it is a contract between two parties who are both amenable to it.

what's so difficult about that?

Hi!

when your father entered into a contract with the condominium seller, your father and the seller executed a "Contract to Sell" the condominium unit because it is not yet fully paid. upon full payment of the purchase price of the condo, the seller shall execute a "Deed of Sale".

considering that you were the one who paid the balance and your father wants you to own the condo, pwedeng mag execute ang father mo ng "deed of assignment" in your favor transferring his right over the the contract to sell to you so that upon execution of the deed of sale, derecho na sa pangalan mo. talk to the developer or condominium owner also kasi there are instances na kailangan ng approval nila ang transfer of rights from one buyer to another.

^Agree with this.  You may just have to pay some taxes, like DST since the assignment involves a real property. 

Maybe what the condominium developer was thinking of is that after the condominium seller and your father would execute the Deed of Sale, mag deed of donation na lang father mo sayo or another deed of sale.  But with what sis vani88ty suggested, less taxes to be paid since you dont need to pay CGT twice or pay a donor's tax pa.
