INHERITANCE - to get or not to get?
« on: June 24, 2009, 11:57:39 am »
Hwag lang akong batuhin, but I want any reaction/advice/constructive comment (o sige, kahit just a funny comment) on anything &/or everything hereunder....   Thank you all in advance.

This is about the Family-I-Came-From  (FICF, for short)

The FICF, basic facts:
Our father had a mistress for the longest time, but that fizzled out -- and swerte kaming siblings, walang illegitimates.

My father and mother have a few assets -- well, not that much as in worth it magpatayan kami sa hatian, pero enough na pag interesan nang lahat, enough to do some mudslinging for.   :)

In the FICF,  from the day you manifest you can understand there are 24 hours in a day --  you will also learn that it is only the sons that will inherit.
It is only the sons that will get the good breaks as in -- educational support beyond college.
It is only the sons who get "perks" -- cars, good allowances,  good clothes, etc.

Ewan ko if she was born with it in her DNA -- but my mom is makwenta... her language for understanding the world, for expressing love, for enjoying whatever --- is money.  As in cash expressed in so many zeroes in different accounts.    Ako may advocacy for women self-empowerment expressed in secret accounts.

Siguro kasi ang hinaharap naming mga daughters eh hopia lang --- we each had our ways and means to bring ourselves up into this world.  Okay naman kami.  Walang sister na "hirap" now.   But we got from Hopia Point  to the  Comfortable Point where we are now kasi nagsumikap kami, real hard work, a lot of self-denials/sacrifices  (saka na lang that Chanel bag!)

(meron pa nahulog sa bus kasi biglang umandar ang bus .. eh lumaki kaming hatid sunod ng driver at car to school, etc. so you can imagine ang tawa namin at galit nya when we pictured her falling off a bus).

Mga brothers -- kasi nga mga heredero -- hay naku,  kahit na ba naka position behind them the funds and assets of our parents ... ayon .. name it, it is there:    loss of a lot of funds (puede nang inheritance ha!)  by each due to sugal, lasingan, chicks.   All brothers have broken marriages -- annulment, abandonment by an exasperated wife, etc.   There are illegitimate children,  recognized and otherwise.  The children na nakapuesto sa mga bahay nila -- lasenggo, sugarol, low performers in school (if performing at all), steal from my mom (jewelry and cash) when they stay with her ..  and a couple minumura sya behind her back, even when other people can hear them:  Bw1sit na matanda!  PI!

So ganoon ang 2 camps in the FICF.
Mga sariling sikap with orderly famlies and good children.
At mga heredero who cannot manage their money, waste a lot of money,  mga kapalmuks, mga walang modo.... the only thing going for the apos on that side is that anak sila ng son ng parents ko.

But we love each other.  Funny ano.
When anybody needs help... hindi namin iniisip na teka -- ilang milyon nga ba meron ka nagets as Xmas gift? tapos ako nagets ko cake?  (oh that is true, believe me).

Tuloy ko novel ko ha.

Marami kaming mga siblings.  Ewan ko ba but sa aming lahat, ako yung default takbuhan pag ang problem is big.  Ako yung may sagot sa financial/legal or whatever diskarte.  Ako yung ever since may last say sa takbo on major problems.

As in nag benta nang property, bumili ng lots .. lahat nabigyan... ako hopia.

Anything that needs to be thought out, for sure it will land on my agenda.  That is how it has been since I learned to answer back my parents at the age of 14.

Excuse me, will continue later.. hindi pa tapos.  I have to attend to some urgent business thing that came up.  Thank you all for your patience.
God bless.

^Maybe hindi lang ako nagbabasa masyado ng GT, but this is actually the first time na may concrete idea ako sa background mo.  ;D

You do know what to do in most circumstances. I can sense that through the way you speak. Ewan ko.  ;D Kaya nga, palagi akong nanghihingi ng advice from you. Feeling ko, i can never go wrong kasi yong nag-aadvice sa akin are people who are smart and empowered women that i can surely learn a lot from. Not to mention, ang dami ng experience about life.  :)

Sige. Tuloy mo na novel mo.  ;D

Thank you JOYCY and LEELA.

To resume,  my brother died and 2 weeks after my dad died.

Ang career ng Material Girl Mom ko is to micro manage the family of this brother and my Dad.
Mga SIL ko have new cars every other year, have Rustan's charge accounts, mga ganoon.

Now we are here.
IN this FICF  -- hehe, alam namin lahat ang legal share sa inheritance.
May last will ang father ko na pinagmamalaki ni MGMom .. nakalagay doon na lahat kanya.
Kami zero.  Pero alam namin lahat na what my mom has eh sa mga brothers lahat mapupunta.
So my sisters are keeping quiet.  Pero inaantay ako to speak up.

Ako kasi pag may nakita akong unfair -- I will try to right it, kahit na ba hindi ako makikinabang. Kaya nga may na gets pa akong townhouse free from my parents for a sister.

Oh she hemmed and hawed.
I said, I leave it to you to declare magkano ang cash ng daddy in those accounts.  What is yours is yours, ano ang kanya?  Did he die penniless?
Coz if you say ang kanya eh P100 pesos ... I want my P10 pesos.
Nagalit na!
Bakit daw pinapakialaman.
Alam naman daughters have no mana, etc etc.

A sister finally said:  kung ganoon pala eh hindi kami trato anak dapat you drowned us when we got out of hospital.

Yung 1 sister quiet lang.  Naiinis ako, truthfully. Kasi madami na akong crusades vs my parents because of her causes --- ako ang gustong patayin ng parents ko pero sya nakikinabang.  Ang inis ko pa, during the time na hindi kami maguusap nang parents ko, eh ang pinagawayan ng grabe eh her interest -- sya pa ang unang susuko!  Sya pa ang unang mag surrender and be tweetums.  Ngek!

So, hubby asks, why do you continue to aggravate yourself with them?

Eto ha ... may investment pala ang father ko na hindi sinabi sa kanya in a company that is doing well now.  Lumapit ang prez at sabi eh eto ang xMillion.
Eto nanaman ako... si duda duda... pinahalungkat ko sa SEC aba!  laki pala kita at nag declare ng dividends the past 3 years.... atching lang ang inabot sa mother ko.  Eto pa, she signed without reading what she signed.  So may kusot ....

Guess.  Binilhan ako ng FrenchFries McDo... ano ako bata?  hay buhay.

So now you see how it is.
Walang intent ang mom ko to fully disclose what properties and funds there are.
Ang sagot ... pag namatay ako everything will be divided equally sa lahat ng anak kong buhay ... either son or daughte.r

I almost fell of my chair nang i kwento ng sister ko.
What a fairy tale.

Atchaka I told my sister... look at history.... sabi eh if you do not correct the mistakes, history repeats itself.
Also, look at history ... there is a pattern.
Ako, speaking for myself, the pattern is hopia!
Kahit anong gawin ko, kahit kumita kayo sa akin, kahit na you exploit me  (sa mga family events kung minsan eh parang ako lang gumagastos) --  hopia pa rin yan.

I said I think now is the best time, and there will be no better time, to demand for a legitimate heir's legal share.

My sisters nahihiya sa mom ko.
Eh may chance pa sila to get something later kasi tweetums sila.

Haba, sorry sorry sorry

So there, ganoon the FICF

Now truthfully --  I want my share!
Eto pa ang disgrasya ni Mother at nila Brothers ... sabi ko I want it all the way.

Sure, I thank God for it every day.

Kaya lang well, anak ako di ba.

Pero... my husband will be very disappointed with me, and borderline obit ako .. pag nalaman nya I received money from the FICF.  Kasi we got to where we are kasi pareho kami pareho ha hindi lang sya nag sumikat... madaming pinagdaanan to get to where we are.

Panindigan ko na daw na walang tinulong at all the FICF sa buhay namin.

Pero well, at times naiinggit ako, like now na wow -- money just like that.

Nahihiya naman ako din kasi although invalid the last will and testament of my dad -- (ako nag contest ng will ha .. gigil my mom of course) -- talagang zero kaming daughters.   Pero there is the law nga ... and we did not get to making an attempt on his life pa before he died ... so, nobody is above the law hehe sabi ... eh di kapalan ko na mukha ko ang demand for my share?

What will you do?

Bakit ba may hiya ako ngayon?
Eh hindi naman ako bumibili ng hiya unless it goes on sale.  And for the past 5 years, wala pa naman akong natalisod na sale ng hiya.
Am I guilty?  Because of my parents'  unchanging stand na kung babae ka hopia ka!

Naiinis din ako.  how unfair!  How dare! What did you think?  We will force our legal claim?  O sige, inisip mo yon Mom eh di gagawin ko -- nasabi ko yon. I want my share all the way... Basta may pangalan ang dad que millions, que real estate, que lease rights, que matchbox yan ... I want my share!

Of course,  nang sinasabi ko yan at sinisigawan ako ... I made sure she was far and couldn't slap me... at malapit ako sa door.  LOL

I have never experienced such a conflict of emotions or thoughts... Kahit na nang ma discover ko my husband had a kabit .. maliwanag isip ko ano ang gagawin ko.   LOL  (BTW,  wala na si kabit.... husband dropped her before I found out.   Pero tignan mo ha,  God took care of me .. binuking pa rin!   God did it in such a way, hindi maka deny si husband.....    My husband knows God takes care of me more than He does him.  LOL   We are okay now, more than we have ever been.  Kasi God dropped a bathtub on him... but that is another story.)

Eto may kwento pa.

Last Monday kami nagsigawan ng mom ko.
Yesterday, nagka usap kami ng lawyers ko.
Sinabi the will is invalid.  Pero kapal ng mukha ko ... nang nagsisigawan kami ng mom ko sinabi ko -- i bet that will is not valid.  (totoo pala!)  But whatever it is... I will test it in court!

Now ang Mom ko wise yan, original Material Girl nga.  IF I go to court ... 35% BIR all the way.
Atchaka sabi ko.   justice grinds exceedingly slow in the Phils. Magkakamatayan na tayong lahat, hindi pa yan ma resolve in court.

Now, mean of me talaga -- if it gets tied in court eh ipit my brothers and their families kasi dependent on my mom.   At siguro worried some sisters kasi may mga naka gets ng properties.  Eh sa labo labo in court,  baka may mag bring up na brother -- bakit si kulasa at si kulapita naka gets nang house and lots, isama yan sa kwenta ng family inheritance for division.... eh madali ma prove kasi pano nila na buy yan kung kanila at hidni galing kay mother and father?

Will I go that far?

Eto eh di nagkagalit na kami.
I told the lawyer... isipin ko if I will press for my legal share.  Kasi if I do... my sisters sakay sa script ko.   Pero along the way... hindi din ako makinabang kasi mabibigay ko din to one of them later on. Parang leaves a bad taste in the mouth.  What do you think?  Or, I am getting soft in the head?  But I sure want money I did not work for.  hehe

Sorry sa litanya.  But OMGrief!  I thank God for all of you who bother to go through it all, who are amused, who try to empathize, who will give me feedback....

God bless you all!

but then may times din kase na you do things not to suffice your needs but to right things...ito depende din talaga if it's really worth the pakikipaglaban na gagawin mo.

sa tingin ko naman, sa naging perception ko about you based lang din sa posts mo sis (which bow talaga ako), shoud you decide to go through it, yong talagang ilalaban mo yong tingin mo tama lang, makukuha mo naman..kaya mo naman.

Basta kaya mo so nasa sayo nalang if i-go-go mo.

i hope i'm making sense here, sana naintindihan ako, di ako magaling mag explain eh. sana nakatulong man lang.

i say go for it sis. after all those years, i think it's about time. you are a legitimate daughter. while reading your post, i thought how unfair your family setting is. bakit ang boys lang? hmmm.. chinese family siguro. but you seem to be very strong-willed and determined through all kinds of situations, and i think in this situation, it is best to use those traits. wala naman siguro masama if you demand your share, because after all, you're still a part of the family. what's disturbing is yung pinipili doon sa family who can benefit or not. it's like.. discrimination!(for lack of a better word). and how can a mother be discriminating to her own children? :ohehe.. i hope you get what i mean sis aquacharly despite my inability to articulate things that well.

then again, what do i know? wala kasi akong siblings. i was raised an only child, but hindi naman kami mayaman so i don't expect any inheritance whatsoever. my dad doesn't have much properties. even though i know he can provide, i can't wait to be financially independent na.

GLADZ , iyon nga iniisip ko eh.  Nabuhay naman kami nang maayos and God gave my husband and I so many blessings.... bakit ko pag interesan yon?

Inisip ko kasi sa kanilang DNA,  long life talaga as in inabutan ko pa the father of my lolo ... they either die in their 40s or die abot 100 and more!

Inisip ko my dad left her in a certain way, with a certain lifestyle.  Pero she is such a sucker when it comes to my brothers and their kids!   Parang ang gulang gulang nya sa mundo pero ang dali nyang makunan ng brothers and their kids!   Linoloko sya ng dilat.  Ninanakawan.

So pag nasa kangkungan my mom, hindi ako makakatiis kahit swapang yan sa akin,  na hindi gumawa nang paraan to get her out.  Eh san ko gets?  Definitely mahihiya ako to get it from my own family.  Kasi nga sariling sikap kami.  And may very very very hurtful memories na inapi api kami ng parents ko.  But my husband and I survived it all... never kami sumandal, never kami umasa.
Actually yan ang sinasampal ko sa face ng parents ko pag nagkaka disgusto kami -- did you ever help  us?  Sinubukan nyo pa nga kami ibaon eh!

What if my husband says later .. ka laki mong t@nga.  She screwed you all the way, and will continue to screw you until she or you drop dead .... she wished us ill/failure tapos eto ka -- the savior? And if by that time, may isip na mga anak ko sa mga ganoon?

When she goes to the US .. marami dala yan boxes.  Ka tiaga mag shopping!  Itatago agad ang ibang boxes .. tapos lahat ng apo andoon, she opens ang boxes she does not hide.
Kinabukasan,  the apos na anak ng brothers (no sisters ha brothers lang)  will go back and have another round of gifts from her.  Pag pasko ganoon.
The kids are young but matalas din.
Ang sabi nang 1 -- why are you unfair?!
Eh kasi pag nagkumpulan sa bahay nya, bakit si ganito may ganito ako wala?  hay buhay.

Going back,
So I wanted my share kasi ilagay ko sa fund na hindi nya puede gamitin until naubos totally all her funds and property.   Last resort kung baga.

Kahit na matchbox yan basta may pangalan si dad, i want my share!  hehe.

Pero tama ka nga GLADZ -- baka hindi ko magawa na panindigan punta kami sa court.... pero on the other hand,  ayoko din na hopia nanaman ako.

CHERUB   oo nga iniisip ko --   bakit ba nobody is above the law.  I am a legal heir.
Kung minalas kami at may illegitimate dyan .. wala kaming magagaw but to give the legal share.
So ako legitimate anak... bakit ako pipigilan to get my share?

Bakit ba ako nahihiya to say, I want some money!?
Guilt kaya ito kasi sinusuway ko uli ang to the end will and wish ng tatay ko na chauvinist or madamot na zero ang mana to daughters?

Pero CHERUB ... I want money I did not work for.  It is an experience alien to me.  Mas enjoy kaya?
Pero kung tutuusin, I worked for that din.  Madami na rin akong ginawa at binigay na legal/financial or diskarte advice to them through the years.  LOL
And it sure was hard being a daughter to them, totoo yan ha.

Thank you both for your patience.
Thank you for your views.

Sorry sa haba nang litanya ko.
Thank you at nakaka vent ako dito
At naiintindihan nyo ako.
Or, you try to understand me.
   T@nga, gets mo your share!
or ...  kapal, pilit mo get your share...

Eh for sure,  puede namang bumagsak ako somewhere between T@nga and Kapal.  LOL

Thanks again!
God bless!

^if i were you, i will demand for my share.. hindi naman sa mukhang pera or whatever.. pero kasi karapatan mo yun being the daughter of your dad.

anyway, magiging equal share naman yan among your sibs. as per your posts, ang pinag uusapan dito several millions and properties, siguro naman kahit hatiin sa inyong lahat yun plus your mom everybody will get enough. kanya kanyang diskarte na lang kung pano palalaguin (or lulustayin) kung anuman yung nakuha nyo from your dad.

it's your right sis.. go for it.. ;)

Ewan ko but when it comes to these things, I feel that the parents have the discretion on what to do with their properties.

If my mom (she's the only living parent that I have) chooses to dispose of her properties/kayamanan by donating it or giving it else where, wala kaming magagawa doon.

Ang stand naming magkakapatid is however my mom chooses to make pamana, we will, of course, take care of each other. Even yung tinaguriang black sheep ng pamilya namin.

And sa totoo lang, I trust my siblings more than my mom.

But then again, nasa sa kanya na yon if she chooses to give us our share or she chooses na magpaloko sa mga alipores niya.

It's just money. I, personally, don't need much. Kung magbibigay, thank you. But I don't think I have any right to whatever my parents worked for (whether they worked hard for it or not).

Kung ako ikaw I won't get yung inheritance, ako kasi yung tipong tao na ayaw ng gulo eh, sa nakikita ko sa situation, malaking gulo/alitan ang possibleng mangyari.  It's not that I don't want the money, but mas important yung peace sa akin eh.

And besides you have proven na you have stand on your own without their help, okay na yun.

You have been good to all of them, pero ganyan talaga ang buhay eh, it isn't fair, kahit anong good mo sa kanila hindi nila na appreciate, life is unfair.  Continue to be good, para good karma.

Isipin mo nalang business yan, you lose some, you win some. :)

Pero whatever works for you, this is just me.

okay, may issue pala. hehe. :D

if i were you, i'd go after my share. it seems your mom is not knowledgeable about inheritance kasi inaako niya lahat. when the spouse dies, 50% of the inheritance goes to the surviving spouse and the other 50% is for the children na. i think this is regardless of an existing will or not.

anyway, habulin mo yung share mo. for me, it's not about the money kasi obvious na may pera ka, aqua. it's the principle of the thing. you are a legitimate daughter and you have a right to your dad's estate.

kalokers nanay mo, ah! :D

LEELA, kalokers talaga si Mom.
My husband says she is 1 of a kind.

Kaya nga once, when I got exasperated with her (again) nasabi ko:  Ma, you are the Truth!  (kiling naman sya.. eh di kinulit ako bakit bakit bakit)
Sabi ko:  You are the Truth, as in the saying:  Truth is stranger than fiction!   LOL,  hindi na ako kumain ng lunch sa bahay nya that day at baka ma Dora as in rat killer, not the cutesy girl, ako.

She knows inheritance rules, believe me.
Ayaw lang talaga mag share with daughters.

For the information of the other sisters here...

INHERITANCE SHARING RULES:

50%  automatically goes to the legal wife.
Kahit na you live on different continents, kahit na si kabit ang kasama 24/7 ... that is the reality,  Legal-Wife-Ako!  gets 50%    may dagdag pa yan, tell you later.

After the 50% -- 25% is divided equally among the legit kids.
If there are illegit kids... they get 1/2 of the share of a legit kid.

So there is a balance of 25%
Listen to this well ha....  :)
The wife gets from that remaining 25% a share equivalent to the share of 1 legit child.
So ganoon nga, the Legal-Wife-Ako!  actually gets more than 50%

Now, the 25% less that last share of the wife .. is what is called the Free Portion.
Yan ang puede ipamana kahit kanino.
Kahit sa butiki mo ibigay.

BUT that Free Portion to be distributed per the deceased's wishes... kelangan may probated Last Will and Testament.  Mabusisi yan, so kadalasan walang ganyan so hindi napupunta sa butiki.

IF there is no probated will or talagang walang will ginawa ....  the 50% after the wife's 50% now is distributed equally between the kids and the wife.
(Illegit kids ganoon pa rin -- gets 1/2 of share of what is due 1 legit kid).

Now, mga wives ... take heed of this well.

There are investments and funds na nakalagay in 1 name only ... either my dad's or my mom's.  Now, maliwanag na my dad's is part of the estate for distribution.
Eto nakalkal ko sa lawyers ko.. kaya gigil ang mom ko at tuwa nang sisters ko... if there is anything under just my mom's name ..  considered pa rin yan conjugal property and 50% of that eh to be divided among her as the wife, and us the kids.

Hehe  akala ng mom ko eh lusot na kasi mga in only her name.  No.  Unless, she can prove that it was all bought or accumulated/funded 100% by her inheritance from her parents.

^if i were you, i will demand for my share.. hindi naman sa mukhang pera or whatever.. pero kasi karapatan mo yun being the daughter of your dad.

anyway, magiging equal share naman yan among your sibs. as per your posts, ang pinag uusapan dito several millions and properties, siguro naman kahit hatiin sa inyong lahat yun plus your mom everybody will get enough. kanya kanyang diskarte na lang kung pano palalaguin (or lulustayin) kung anuman yung nakuha nyo from your dad.

it's your right sis.. go for it.. ;)

Hay naku, ALPHA .. magugulat ka.. When there is more than enough, dyan mas matalas ang Greed.

Kalokers nga ang mom ko .. she wants it all.  Not that she is greedy,  oo andoon na rin yon,  but kasi nga ang language nya is money.  Atchaka if she holds the money,  machunurin ang mga brothers ko and their families.  For her, it is all about Power.  Kalokers nga, as Leela said.

Ang mga brothers ko, and their wives and kids, who always had it easy ... yan ang hindi marunong mag share. Aba!  Gusto ko sagasaan nang bulldozer when 1 sister said that he considered forging my signature para ma sell yon. Imagine!  That is 1 of the brothers who has more than enough na hindi pinaghirapan  Well, medyo nga mahirap pakisamahan si Kalokers "Truth".

Hindi nga ako makatulog now.
I am really conflicted.
My mom earlier asked me if I signed the waivers for the banks so hindi ma freeze accounts with my dad's name.  Sabi ko mainit pa ulo ko at ayoko isipin. Pero may deadline sya eh .. end of June.

Huh?!   Weird.
Ayoko tuloy sign the waivers ...  hehe, bakit hindi naman adobo ang language of love ko.
LOL

GRUMPY BEAR, SWEET PAIGE, thanks for sharing your thoughts.

OO nga, win some, lose some.

May takot din ako sa pag insist on getting my share.  Kasi para bang noong hopia kami ni hubby,  eh very comfortable ang buhay ng FICF lalo na my brothers.  Pero ang napansin ko hindi sila happy.  As in may peace of mind.  Magulo, maraming sabit.  Marriages were crumbling left and right.

Parang it does not bring happiness... but brings conflict.

God bless!

Hi sis :)
It's hard to tell kung ano gagawin ko if I'm in your situation.

Kasi pag pinabayaan ko si mom na wala kami na maiinherit from my dad, parang hey! sobra na ito!
like you said, you're always their helping them not only in financial matters but in any problem that they need you but in the end you're the one who always left behind.

But at the same time..............
Mahabang process ito.... mahirap, in the end baka kayong magkakapatid ang magkaaway away in terms of money, may iba pa nga family as in nagpapatayan just to get that inheritance.

I know you're fighting naman for your rights. But is it worth it?

Like you said, hard earned money brings much happiness... You and your husband did'nt get any help from your FCIF when you're in need... but you remain strong and now very much happy with your husband and kids.

So think it over,
Pray for his divine guidance,
you can never go wrong when you ask for his help.

God bless you and your family.

aquacharly. i read your posts all the time. i agree it is important, like you once said, to be around people who are not redundancies of your own perspectives. or something like that. but anyway thank you for sharing intelligent posts.

what i think is. you will not have peace of mind (your own kind of peace of mind)if you do not go after your share. not because of the money. but because you think it's all a very backwards thing. the daughters not getting their inheritance. and you will not put up with it. but that is just what i think.

another thing i alway remember though. what they say. when you are right, that's all you get to be.

if i were in your shoes i will go after my share. just to prove a point.
