how long did it take to get your spouse and siblings to be with you???

what is the process and how long would it take for the petition to be approved?

when did you get them, nung H1B ka pa or greencard???

hi eimerej5  as an H1B worker, one can have their dependents to accompany them when leaving for the US by H4 or Dependent Visa. However, dependents are not allowed to work. They can leave at the same time that the H1B visa holder will be leaving for US.

My husband is a PT and he got selected in the H1B lottery. We got married a month ago so that I can accompany him when he leave by Oct.

I think this is much better since the H1B applicant can concurrently apply for EB3 (GC) while working using the H1B visa. If the petition was approved, all the dependents that he has can be immigrant as well.

ours is like this:
-hubby came to the US on a tourist visa from Singapore, since my kids and I didn't have visas we went home to Pinas muna..that was nov 2001...
-he was petitioned for H1b in March of 2002, we got our H4 in August  and we came here in Dec 2002

-he transferred his H1b to a second company, where he was petitioned for a greencard under RIR

-he moved to another company again where they re-appplied his greencard under PERM (EB2 category)...he applied August 2006, LC was out in Oct 2006, biometrics in Dec 2006, work authorization in Feb 2007, Adjustment of Status in August 2007, and finally the much-awaited greencard October 2007

-right now, hubby and myself are still working in this company  - that petitioned us (including paying for everything, lawyer's fees, etc)...no strings attached actually, but why leave a company that doesn't make you sweat blood and tears.....

-fyi, we work for an architectural company - they don't petition for new H1bs, they prefer transfers only....

^ah ok so pwede pala yung tourist visa ka then convert to adjustment of status na tama? yung form I485? bakit sa ibang case kaya matagal...ang adjustment of status will take 3 years para marelease ang greencard. then after nun, can the applicant marry and get his wife to stay with him? hindi ba delikado yun? kasi nagapply ng adjustment of status as single, then nagmarry during the adjusted process?

^tourist visa then get an employer to sponsor you for a working visa (H1B) then if all is well they will then petition you for a greencard.....
matagal talaga dati, yung ibang nag-apply from working visa to greencard, under the traditional application, waited a long time....
ours kase was under PERM and EB2 category, meron din naka-PERM and EB3 category, medyo mas natatagalan ata yung sa kanila....
yung friend ko, sabay lang work auth namin and our husbands were both EB2, pero yung sa kanila one year plus na di pa rin lumalabas ang greencard, so they needed to extend pa their visas....

my hubby's H1B was issued here in the US so di sya allowed umuwi....although some were saying pwede daw....i don't know anybody talaga na gumawa nun....

i was able to go home since ang H4 ko was issued in pinas....

better consult an immig lawyer para mas maintindihan mo ang process....

ang alam ko din kasi is that kapag H1B na ang partner mo it is faster or easier to get your dependents kaysa kapag greencard ka.. like sis twisted_pop and gnela_21... Nakakasunod sila kagad or sabay...

Problem is, there is an ongoing retrogression with regards to the Visa Number. Based from the recent Visa Bulletin, EB3 category is still UNAVAILABLE, meaning walang visa number na pwedeng ibigay.

my fiance has an H1b visa and we're getting married next year para makuha niya ako using H4 visa. sa fiance ko pinaprocess na greencard niya and ihahabol marriage certificate namin at iba pang documents para ma change status niya from single to married. pwede naman to sis kasi ang lawyer mismo ng company niya ang nagsabi.

what's better, marry your fiance before he gets issued a greencard or marry him after he gets a greencard? will marrying a petitioned applicant will get in the way of him changing his status from single to married?

its better to petition ur spouse and siblings before the petitioner's visa be converted into a greencard. mas mabilis kapag h1b muna si hubby den h4 ka naman at mga kids...

it happened to my sister in law.. h1b siya when she petitioned her kids then may interview na, ok n sana lahat kaya lang due to some circumstances hindi sila nakapunta sa interview. 

Ngayon greencard na siya, ang tagal ng interview date mga mga anak niya though approve na sila... kung sana nakapunta lang sila sa embassy, nasa us na sana mga anak niya ngayon... dito pa sa pinas mga kids niya.. hopefully by christmas nandun n sila....

hi sis jaymie! andito na rin pala hubby mo sa US & sunod ka na rin pala by oct. tagal ko di nakapagbrowse dito, ngayon lang ulet nagkaron ng time..

interesting ang na-open mong topic. sobra akong nakakarelate.. ang alam ko kase, on-going na processing ng greencard ni hubby, sponsored by his employer. but til now wala pa rin kami update kung ano na status..

H1B Visa holder cannot petition anyone. Pwede lang nila isama yung dependents nila (spouse and kids) which will be on H4 or dependent visa. Immigrants can only petition their spouse and kids (pag-approve na, immigrant na din sila) while only US Citizens can only petition parents and siblings.

kasi h1b ang gustong visa ni hunny dahil nga mas mabilis, paglabas ng h1b kasabay na yung sa amin na h4. dahil sabay niya ipinasa..

Tama ba yung gagawin niya???

I'm a newbie here.  ayun, may problem kasi ako, i hope maliwanagan ako.

My boyfriend kasi has an H4 Visa. Mag-eexpire before his birthday, so sa Jan. 30, 2008 mag-eexpire na. Mom nya is a registered nurse, nasa US na ngayon. Kasama na ng mom nya yung sister nya (h4 visa holder din) dun sa US ngayon-- nauna na silang umalis (nung Sept 2008 pa). My problem is this: Sa Christmas, pinapapunta na dun yung boyfriend ko. Sabi ng mom nya mag-vivisit lang ang boyfriend ko dun. But we (ako and my bf) have this kutob na baka gumagawa na ng move yung mom nya para sa migration nila or something. It's his mom's dream daw na magsama-sama sila sa US (that means, i'll be left behind  )The truth is, ayaw ng bf ko na magpunta sa US dahil recession nga dun and he thinks wala syang matinong job na makukuha dun na related sa course nya (BS Economics sa UP Diliman) and aside from that, maiiwan nya ako dito sa Pilipinas (how sad). 2 semesters na lang at gragraduate na kami.

Now, paano pag sa December, pagpunta nya sa US ay pilitin sya ng mom nya na mag-stay na doon. In the first place, hindi pa sya graduate dito (so basically anong work ang maghihintay sa kanya dun? Gasoline boy? Cashier etc? Come on!) Secondly, kung sinasabi ng mom nya na mag-aaral sya dun (further studies or i-cocontinue ang studies), magkano naman ang gagastusin sa college? Mahirap yata yun dahil mahal ang cost of living sa US and nandun din ang sister nya, then nag-rerent lang sila etc.

What do you think-- ano ang ways na gagawin ng mom nya? Magsestay ang bf ko dun for years? H1-B and mom nya and H4 ang bf ko. Paano/ ano ba ang mga process na gagawin ng mom nya, e mag-21 years old na ang bf ko. Help naman dyan, yung mga knowledgeable sa US visa conversion etc. Iiwanan ba nya ako? How many years? Or pwde ba syang i-petisyon at dito muna sya stay sa Pilipinas? What??? Mayroon bang student visa pabalik dito sa Pilipinas. I mean, mag-aaply sya sa US ng visa para makapag-aral/ continue his studies dito sa Pilipinas? If yes, what type of visa is that and how long yun ma-poprocess? He needs to be back 1st week of january 2009 eh. huhuhu

We are really desperate.

sis angel_princess, the only next step na alam kung gagawin niya is to file a greencard visa or immigrant visa, since h1b na cya. and kapag naconvert cya into greencard pati dependents nya, ganun din ang visa. meaning kung h4 ang bf mo, magiging gc holder n din cya.

before the process takes yrs but now, sa experience ko from my sister in law, it took only 6-9mos. h1b din cya dati...

pede tlaga cya mgaral dun kapag gusto ng bf mo pero di cya pede mgwork... dependent kc ang visa nya.

^^ im not sure if ang sasabihin ko ay accurate, tama niyo n lang po ha, based lang ito s experience ko.

the only thing that your bf's mom can do is file for greencard (hanap lang siya ng sponsor; pwedeng ipetition nya sarili nya if she stayed na in the US for 5yrs) after that she can petition na her kids, this would take months sometimes years, so i really doubt kung makakasama pa s petition ang bf mo, kasi as you said he'll be turning 21 next january.

if your bf dont want to stay in the US all he needs to do is tell his mom, kasi wala namang magagawa yung nanay nya eh, maoover age n sya kaya hindi n pwedeng iextend yung h4b visa niya.

ay sobrang tagal n pala ng question, LOL
