Derivative Status: Getting a status (visa) through another applicant, as provided under immigration law for certain visa categories.  For example, the spouse and children of an exchange visitor (J Visa holder), would be granted derivative status as a J-2 Visa holder.  Derivative status is only possible if the principal applicant is issued a visa.

My sis-in-law is a nurse on the Eb3 category  she can take her husband and children along and lahat sila for immigrant visa


yung friend mo immigrant status pa lang sya di ba since sibling ang nagpetition, so once maging green card holder siya (usually take a month or 2 after arrival) pwede lang sya mag petition ng immediate family member like spouse and kids.

Yung case ng mga relatives ko naman pinetisyon sila ng brother nila na US citizen na after 20 or more years nakapunta yung mga kapatid dito together with their immediate families as derivatives.

sa case ng friend mo, parang wala pa akong nabasa na pwede mangyari yun na kasama ang fiance sa petiton unless what you meant was may visa na yung fiance and sasabay lang sya sa pagpunta dito.

maging permanent resident man siya ...sa pagkakaalam ko  US citizens lang pwede mag file ng petition para sa fiance.

Yes, husband and children (under 21) can be included in that petition that is under F4 categories

hello. my husband told me he just received NOA2 at approved na daw yung petition namin (tagal ng intay namin buti na lang approved na). Mga gaano katagal before sya ma-forward sa USEM at gaano katagal from approval to medical and interview? I'm clueless

Question mga sisses, I hope you can help me:

I am a US citizen by petition na 1992 pa na-approve (US Navy kase dad ko but he died the same year)but next year ko pa lang balak umalis at mag-hanap ng work kase andon bestfriend ko sa NJ. I have a US passport and SSN. Now, I have a bf and we're getting married next year. here are my questions:

1. Gano katagal ba bago ko sya mai-petition granting na kasal na kame pag-alis ko next year?
2. What are the pre-requirements/pre-qualification para makapag-petition?
3. Do I need to have a show money or anything?

I hope someone can enlighten me. Kase big step para sa min talaga 'to.

^kung may tourist visa bf mo, here na kayo pakasal. that's what we did not too long ago. mabilis and mas convenient dahil magkasama na kayo here while processing. for us, dumating siya here ng Feb and by Aug complete na lahat except for the Green card since talagang matagal makuha yun. working permit, ssn, license meron na.

no show money na kailangan except mas mahal ng konti if magadjust ng status. just have to prove as usual na genuine ang relationship. we started opening bank accts, cds, added him in my insurance, both names sa mga bills or sa lease, sa car etc.

if papakasal sa pinas, I think sa mga nabasa ko here from 1-3 yrs ang frame. depende sa processing. matagal na, hindi pa kayo magkasama. if more than 2 yrs na married, 10 yrs kagad ang GC niya kung hindi e 2 yrs ang makukuha niya.

^^Ganon sis? Kase andito kame pinas pareho and sa April namin balak pakasal before ako umalis ng mid year next year. Wala din sya tourist visa. Yung I-130 ba mismo yung mejo matagal? Kase according sa info na nabasa ko, pag approved na yung I-130, hinde na nya kelangan maghintay ng visa number kase may available na kagad for spouses of US citizens. Tama ba initindi ko?

More than three years na pending yung petition namin ng sister ko... waiting for approval. Any ideas kung bakit sobrang tagal ng processing sa California Service Center? Perhaps sobrang daming petitions doon?

kami rin pinetition ni mader si sis, F2B naman siya. according sa website ng USCIS - 2005 daw ang pina-process for that category sa california service center. i wonder if true.

question lang po mga sis, boyfriend ko kasi 3 years pa lang sa california, bale 2 years pa bago siya maging american citizen and after nun i-petition sana niya ako as fiance'.

advisable ba na magwork muna ako sa ibang bansa like for example canada or singapore then pag malapit na niya ako petition balik uli pinas para asikasuhin yung fiance' visa?

or mali yung gagawin ko na yun, kasi baka maging complicated? mahihirapan ba ako makakuha ng fiance' visa if nag work ako for 2 years sa ibang bansa? hope someone will enlighten me.. Thanks in advance..

^ No. I don't think so... it will not complicate things unless you will do something na makakaaffect sa petition nya sayo like falsification of public documents, etc.
   Dapat pag nagwork ka sa ibang country continuous pa din ang communication nyo to prove that there is an ongoing relationship between u and the petitioner (e-mails, snail mails, call logs, chat, remittances) indicating your name and his name.
   If you will work abroad ang alam ko na hihingin lang sayo ay police clearance just proved na your record is clear.

My husband is American. Check mo kung kailan mag e-expire ang visa nya. Before it expires, go to the Immigration in Intramuros and ask for a visa extension. Extension is 60s per renewal and I think pag first time, pwede 1 year.
