^hi sis. kayo ba mismo nag asikaso din ng pa-transfer? pwede malaman pano nyo nacompute yung cgt and dst? thank you.

Di ko alam sis ang parents ko kase nagasikaso. pero eto ang binayaran ko.

Ang capital gains tax namin ay 28,770 at ang documentary tax ay 7,200. Based yan sa nakalagay sa price ng pagkabili ko sa may-ari, which is pinalagay lang namin sa deed of sale na nabili sya sa 479500. Jan kase cocomputin ng cityhall yung sa capital gains. Kaw na lang magcompute. hehe.

Pinababaan ko talaga yung ilalagay sa deed of sale, kase ang bayad sa abogado e 1% din ng pagkabili sa seller. Kaya sinabi ko sa seller na kukulangin ako at kung agree sya na ganun ang setup para di na mapalaki yung ibabayad ko sa abogado at sa cap gains nga.

Capital Gain Tax - 6% of Total Contract Price
Documentary Stamp Tax - 1.5% of Total Contract Price

Sa BIR po yan binabayaran. Iba naman po ang computation ng babayaran sa Register of Deeds.

Normally you need to pay the lawyer kasi siya gagawa ng Deed of Sale. In my case I already have the template of Deed of Sale so I just edited accgd to the details and after we signed we notarized the document.

^Thank you sis. Sorry, magtanong lang ako uli ha baka sakaling alam mo. Nakuha ko nakasi yung computation ng CGT and DST from developer. Condo naman yung sa akin, pero naka mortgage pa sa bank. So binebenta ko ng walang mark up, kahit maibalik lang lahat ng naibayad ko. Nabanggit mo na kayo nagpalagay mismo ng amount sa deed of sale. Yun din ba yung presyo kung magkano nyo nabili yung property? In my case kasi mas mababa yung list price na bigay ng developer na basis ng CGT kaysa sa selling price ko. Iniisip ko na usapan nalang namin ng buyer kung magkano ilalagay sa deed of sale, para makamura kahit paano ..may kalakihan din kasi aabutin eh.

Ganito sis, kunwari ang list price kasi ni developer ay nasa 720,000 lang pero ang selling price ko is around 800,000. Pwede naman siguro yung 720k na ang sundin namin no tutal galing na sa developer yun.

Puede naman as long as both parties agreed. Kung ano ipapasa mong deed of sale sa bir yun ang cocomputan ng cgt and dst.

Meron pa sa RD. kasi iuupdate din ang Tax Declaration mo. Pero mas maliit na lang.

Yan po lahat. Naka itemized kasi sa excel ko yan para I know for my future use. Masalimuot pero ok lang at least I know how to do it na.

If meron kayo time puede nyo din gawin makakamenos kayo ng fee... at least maintindihan nyo din ang process. Minsan kasi if we rely on someone else tapos natagalan sisisihin natin sila bakit matagal unlike pag tayo mismo lumakad alam natin kung bakit... kung meron lang kayong oras kung wala naman hanap kayo ng gagawa.

How long before the seller can get the payment if the buyer had it financed via bank loan?

^it depends on when the Transfer of Title will be completed. ang panghahawakan mo lang from the bank is Letter of Guarantee, andun ang amount kung magkano ang babayaran ng bank sa iyo. etong LoG makukuha mo agad ito once ma-approve ang loan ng buyer sa bank. pero ma-e-encash lang ito upon completion and submission of all documents to the bank.

Hi. Magtatanong sana ako sa case ng friend ko. Naforeclosed ng banko yung bahay nila kase niloan nila ang renovation nun before pero hindi na nabayaran. Pag ba naforeclosed na, kunwari nakikipagusap na yung friend ko sa pagibig, para mabuyback nila, may chance ba yun? Iooffer ba ng banko yung property sa dating mayari bago ioffer sa ibang tao?

^ang alam ko sis, nasa law natin na may 1 year redemption period pa, I am not just sure if this is applicable din sa bank loans, pero tingin ko oo. i-check nyo rin.

Hi mga sis.. I am planning to apply for housing loan.. pre-owned sya and ipapa-appraise ko sa bank. Base sa backread ko usually lesser than the selling price di ba? Pwede ba ideclare namin na 4M un price kahit na 3.6M un selling price ni seller? 2 years old pa lang yung house and yung price range sa metro manila ng 68sqm house is nasa 4M. Meron ako nabasa na pwede sya iarrange sa bank para macover un amount. Need pa kasi ipatitle transfer ngayon gusto ni seller kami na din sumagot ng seller's tax and fees. Sayang kasi un deal problem wala ako hand on cash lahat nasa stocks di namin mawithdraw dahil super bagsak un market ngayon :( thanks mga sis sa sasagot

^when the bank appraises a property, they don't care how much the selling price is. They always base it on the appraisal amount. maximum of 80% ng appraisal amount ang pwede nilang ipa-loan, kung may kilala ka sa bank, pwede pa siguro isagad sa 90%.

kahit gawing 5M ang selling price, pero kung ma-appraise lang nila ng 3M, ang pwede lang nilang ipa-loan is 2.4M.

tama si sis bluish_mommy. even if you put the price as high as you want, it still depends sa appraisal ni bank. 

ang ginawa namin non sa house (we were renting it kasi then the owner sold it to us), as suggested by my cousin who did all the processing for us (her company does that heheh), we re-painted it.  so 2.3M binenta ni seller, 1.8 ang appraisal ng pag-ibig (pag-ibig kasi namin pinasok), so 80% non ang loan amount.  we just got lucky kasi yong difference, we are paying installment sa seller.

Thank you sis sa mga sumagot. May friend ako na masmataas daw mag appraise ang pagibig compare ke bank. Nagpasa na ako ng requirements kahapon and hoping for the best. sana konti lang difference.  ;D ;)
