reqts para sa petition ng anak sa labas

my husband has a child under a bigamous marriage which was nullified a few years after the kid was born. i am the legal wife and we have reconciled just a year or two before his marriage to the other woman was nullified. the woman did not ask for child support nor demanded father-son.contact since the day my husband left them and came home to me.

today, seven years after my husband abandoned them, my mil informed me that the woman is already in australia and wanted to bring the kid with her. btw, the kid is living with the maternal grandparents. my husband and his mom have not communicated with the kid but his sister in law is friends with the woman. so this sil calls my mil to tell me to give them my husband's passport or drivers license as proof that he is the kid's father so that the mother could arrange for the child to join her in australia.

sis di ko alam kun ano ba talaga requirements pero sa tingin ko kelangan lang ng proof kun sino talaga un father ng bata...and I think, dapat din naman na ibigay un ng hubby mo kun ano man un kelangan nun bata para makalipat ng Australia...afterall, wala naman sila iba hiningi di ba...ito lang...so pagbigyan mo na, malamang kelangan talaga un para makaalis un bata...

Be civil and talk to them kung ano talaga yung requirements na kailangan after all its long over due na.  If di mo kayang harapin sila let your husband talk to them. Don't think na it is for the mother of the child, it is for the child itself na wala namang kasalanan. As per your story your husband is not giving anything and the child is not asking for anything, ito lang to be with his/her mother. And if you think of it, di naman choice ng bata yan to be in that situation and the child has all the rights to demand for it. Wala na ngang tatay kaya with a good heart pagbigyan mo na para magkaroon sya ng nanay sa tabi nya.

This is based lang sa kwento mo and not a bias opinion ha, unless you didn't stated the whole kwento.

^^thanks for your input. ako naman, ok na rin na.makaalis yun bata para wala na ko worries na makakasalubong namin sa kung saan lalo na ngayon na may baby na rin kami.  we have not talked about how we are going to explain the situation to my baby kasi maliit pa naman sya. so siguro pag wala na dito ang anak nya sa labas, medyo low yun chances na magugulat na lang sya basta na may kapatid pala sya sa labas. anyway, i still plan on telling him everything pag naiintindihan na nya kasi ayokong magulat sya later on na ganun pala history ng mga magulang nya. lalo na at mas bata sya sa anak sa labas ng dad nya.

anyway, kaya naman medyo hesitant ako to provide these papers kasi the woman, eventhough their bigamous marriage has already been nullified since 2009, is still using my husband's name sa licenses and even sa passport nya at siguro pati sa mga papeles nya papuntang australia. i came to know about this kasi naikwento ng isang common friend nila ng husband ko. i think nahihiya sya ipaalam sa mga tao na nagcommit din sya ng bigamy kaya ang gusto nya palabasin sa mga tao eh, si hubby ko lang ang married before they got married. kasi yung asawa ko ang nagfile ng case eh, so ang lumabas sa civil case nila, yung babae ang kinakasuhan. his lawyer advised him to omit sa kaso na sya din ay married sa akin. tsaka siguro kaya yung name pa rin ng husband ko ang ginagamit nya eh dahil di nya magamit ang maiden name nya kasi married pa din sya sa original husband nya. haha magulo ang buhay ni nene. yan kasi.

so anyway, someone naman told me na baka daw kasama ang asawa ko sa petition, na syempre di naman mangyayari kung walang say ang asawa ko. i know my husband loves me and our baby, but this ls opening old wounds again sa akin. :(

btw, di ba ang legal document to prove paternity is the birth certificate which the mother could provide naman? so why ask for my hubby's passport or driver's license? sana me makapagsabi sa akin ng process sa pagpetition ng bata sa australia para di naman ako paranoid haha. baka nga naman legitimate yun reason for request ng mother ng bata for my husband's papers.

Ate, sabi nga sa Frozen, "Let It Go"....

Pasalamat ka na yan lang ang hinihingi nung mother kasi kung talagang sya naman ang father nung bata, que bigamy pa yan or nullified ang kasal nila, anak pa rin nya yun at may habol ang bata sa asawa mo, more than his license at passport number.

And so what if she is still using your husband's surname? As long as nullified ang marriage nila, hindi naman automatic ang change ng mga papers nung babae into whatever name she pleases. Baka naman masyado lang matrabaho for her, given na single mother sya for the past few years dahil inabandon nga ng asawa mo ang responsibilities nya as a dad.

Kung gamitin man nung babae sa pag file ng papers sa DSWD or sa Australian immigration ang details ng asawa mo, I don't think wala ka rin lang namang choice dahil sya ang father sa birth certificate ng bata. Gusto mo pa bang idaan pa nila sa korte? Diba mas malaking sakit ng ulo yun? And besides, ano ba ang kinakatakot mo - diba assured ka naman kamo na love ka ng asawa mo? I don't think na kakaladkarin naman ang asawa mo papuntang Australia with them dahil lang nagbigay sya ng information na yun...

I would say that this woman has given your husband an exit pass, you should be grateful. Even though it opens old wounds for you, don't make it worse by being paranoid. You have to be civil and try to cooperate with her, the last thing you want is to start a fight with a mom about her child. You will eventually realize na there are no limits as to what damage a mom is prepared to do for her child.

May friend ako, she is a single mom. She and her then fiance eh ikakasal na dapat after she gives birth to their child. Kaso na discover nya na may babae Yung fiance nya after nya magnanak, so hindi na nya tinuloy ang kasal.

So now, she is single. The father of the child is single parin. She wants to move on, kaso iniipit sya nung guy. The guy still wants to reconcile. She doesn't want na.

She wants to go to Australia with her child. Problem nya the child carries the surname of the father and she still has her maiden name kasi di natuloy ang kasal nila. She needs the dad's cooperation daw on certain papers na parang pinapayagan ng dad umalis yung bata.

So TS, tingin ko this is your husband's decision to make. I don't think you have the right to decide din on this matter. Of course, your hubby can consult you, pero final decision iyan ng hubby mo as it concerns his child.

saka sis, yes it will open old wounds nga, pero di naman un fault nun bata...fault un ng hubby mo (which, cya talaga un puno't dulo nito)...kun napatawad mo hubby mo, dapat din di ka na maging bitter about dun sa bata....

wala cya alam dun di ba...victim din cya kasi lumaki cyang walang ama...

Don't worry too much if the mother is still using your husband name. It is a legal documents, eventually kung magkakaroon ng complications yan sya naman ang mahihirapan. Kahit sabihin or ipamalita nya na husband mo lang yung nag-commit ng bigamy, null and void pa rin yung kasal nila.

hay i have no plan on getting in a fight with a low life b**** who just happened to be the mom of my husband's kid. i just want to know how these documents are going to be used. ikaw ba pag hiningan ng papeles ang asawa mo saying need daw dahil blah blah blah, give ka agad? she has this habit of using the kid as leverage with whatever unsavory plans she concocts in her evil head. the only reason she did not ask for any child support then, was that ang tingin nya sa asawa ko from her own words ay patay gutom. she probably found out that my husband is giving us a good life and that we already have a kid kaya gusto na naman manggulo.

priceless, my issue here is not about letting things go, because believe me, if that is the only way to be rid of her, mabilis pa sa alas kwatro give ako. i dont need a lecture about a mom going through lengths for her kid because i am also a mom. alam ko yan.
if u read my reply to.the.original post, u would have known na i am willing to "help" kahit nga for selfish reasons na lang. i just want to be sure that my husband's documents won't be used for other purposes. i guess this paranoia on my part is just a result of years of dealing with this b****'s b******t. i guess only a legal wife who had been betrayed would understand how i feel right now. just like any legal wife, i also would like to protect my child and my family so why would anyone make me look like i am the contrabida here? gaya ng title ng post ko, requirements sa pagpetition ng anak sa labas. need ba talaga magprovide ng drivers license at passport ng tatay? kasi yun ang hinihingi nila. siguro kung notarized consent to bring the child abroad ang hinihingi from my husband, with supporting dox wala akong question. but they are not even asking my husband to sign any papers. so ano ba talaga?

girltalker, hay siguro kung totoo nga na sa pagfile ng visa nun bata gagamitin yung papers ng hubby ko wala naman problema. hindi ba nabanggit sayo ng friend mo kung anong dox ang hinihingi hehe. same siguro sila ng sitwasyon. my husband will probably be ok with providing any papers as long as para talaga sa bata. on my part, i won't stop her na kunin nya ang anak nya. the only thing that pisses me off is that minura mura nya ang pangalan ng asawa ko, tapos ginagamit pa rin nya? i have forgiven my husband and i do not hate his kid, but i still hate that b****.

^I am not (or anyone here for that matter) trying to make you look contrabida. What I merely pointed out is that there are battles to choose and this one, especially when it comes to his kid, wala kang laban. So even if the mother decided in the past not to claim any financial support from your husband - that does not relieve him of his obligations - unless of course nag sign na sila ng papeles before that he is relieved of any parental duty or support. So in the future if the mother really wants to go to lengths to squeeze every last centavo, information, time, etc owed to her child, then she can do that - which I'm sure you know anyway. If you can make her life difficult, I think she also has the power to do that to you - and by the sound of it, she's not one to shy away from a fight.

And you don't have to point out that you have rights as a legal wife. Don't think that because I've written what I wrote, kinakampihan ko yung other woman or ang mga kabit. But the kid's got rights as your husband's child. And yes, you just have to accept that as long as he is his father and he is a minor, pwedeng pwede talagang gamitin nung girl ang anak nya to get what's rightfully owed to her child and there's not a lot of things you can do about it.

Don't go on the offensive kaagad - tama yung suggestions dito, have your husband talk to the woman directly and ask her what her plans are, what's required from him, etc. rather than drawing conclusions over second or even third hand information.

the only question i wanted answered is kailangan ba ng drivers license o passport ng tatay pag nag aaply ng visa pa australia?

si girltalker nagbigay ng example na nakatulong kahit pano na me ganun nga although di pa namin alam king ganun din bang dokumento ang kailangan.

yung iba nagsabi na bigay na lang kasi kawawa naman ang bata kasi wala naman kasalanan. yung iba nagsabi na maging civil na lang ipakausap sa asawa ko kung ayaw ko na makisali sa usapan dahil sa old wounds. btw, these comments even though they dont directly answer the question were helpful because they are probably written in a non-condescending manner.

ang pinagtataka ko lang naman eh yung mga comment na para bang kinakawawa ko yung bata at parang utang na loob ko pa sa nanay nya na di humingi ng sustento? bakit tayo nakarating dun? pati yung makipag away ako sa kabit? if i made u think that i will deprive that boy a chance to be with his mom just to take revenge, to the point na pahirapan ko sya, sorry pero mukhang wala naman akong isinulat na ganon. Uulitin ko, willing akong tumulong as long as yun talaga ang purpose.

if someone told me that yes, a father's license or a passport is really a reqt for a child visa, per own or a friend's  experience, that would be a great help.

wala akong balak makipag away sa nanay ng bata. hindi ko rin inaalisan ng karapatan ang bata sa asawa ko. In fact nabanggit ko na mas ok nga na kunin na lang sya nung nanay nya. this post was made dahil naghahanap lang ako ng info dito kng talagang proof ng paternity ang drivers license at pasaporte sa australian visa? Kasi sa pagkakaalam ko, birth certificate ang kailangan para malaman kung sino ang parents ng bata. as far as i know kasi, pag minor ang kid and the parents are separated/divorced, need ng other parent ng consent sa isang parent para itravel ang anak nila? Eh walang hinihinging ganun yung babae eh, so medyo doubtful ako sa totoong purpose nya. Again, that's why i am asking kung yung documents na yun talaga ay requirement sa application ng visa for the kid. Kasi kung hindi, maybe me plano na naman ang babaeng ito sa husband ko. Yun lang naman yung reason at info na hinahanap ko sana. unwarranted naman kasi yung mga ibang comments kaya nagreact ako. siguro din, if someone had been at the opposite side of the situation ganyan din siguro magiging reaction.

I dont want to fight with anyone, but siguro, we should reread the thread starter's posts and replies first before they respond kasi sometimes nga unwarranted and sometimes offensive na yung mga comments.

Sis, everyone understand you naman. To tell you honestly medyo on a negative side lang kasi yung intro mo and di lahat ng tao is considerate enough to give thier comments, minsan you'll get talaga ng sobrang harsh. They didn't think of your feeling naman kasi but only on how they interpret yung posted topic, kaya iba iba talaga. I can't say na totally wala kang mapupulot sa ganyang mga comment pero minsan kahit masakit may point din naman na pwede mong makuha. Basta huwag mo na lang pansinin if you knew na di makakatulong sau. You yourself lang knew who you really are.

OT: as an advise ask question that is  straight to the point, to filter the answers and maiwasan ang side comments... hehe... chill lang sis, don't stress yourself, focus ka lang sa gusto mong masolve na issue or problem.

And yes tama yung isang sis dito na baka mas masagot yung question sa legal matters :)

Your initial post asked for reactions from everyone. If for example, you just posted a question about the requirements for your husband's child's petition, then you could've gotten a more direct list of the requirements even though this might not be the right forum for it.

The thing that I've noticed here in GT is that as much as most ladies here hate the other woman and kabits, they are fiercely protective and concerned about a child's welfare, whether that child is legitimate or not.

I'm going a bit off topic now but going back to your thread and posts, I don't think it was as simple as   asking for the requirements for immigration. I mean, why else would you air out all the grievances that you have against the other woman, or your philandering husband for that matter? And you talk about the advice being given to you in (what you think is) a condescending manner - when your own  posts are already tainted with so much hate. It's the pot calling the kettle black.

If you really wanted to know the requirements for immigration into Australia, tama, go to the legal forum. O kaya go to the travel section.

TS, ramdam ko ang inis mo inside. Mukhang hindi ka pa nga nagh-heal totally.  By the use of the words "anak sa labas", "bigamous marriage", "b****", talagang nahihirapan ka magmove on.

I know this comment may not be what you want to hear, pero totoong you really have to move on, for your sake.  Alam ko it is not easy, kasi I have been in your situation.  Worse pa kamo sakin, kasi hindi inabandon ng asawa ko (ex ko) ang anak nya sa labas.  Minsan di ko nga alam alin ang mabuti, i-abandon nya - para at least di na sakit sa ulo pero it shows his character naman din.  Pero hindi nya i-abandon, lifetime burden for the legal wife (ako) pero alam mong walang kasalanan yung bata.  But the point is, kahit pa umalis yung bata to Australia, I am afraid na mahirap ma-"banish" sila forever.  It was a reality na nangyari, your hubby just have to face the consequences.  At since you reconciled and accepted him again, kasama iyan na kelangan mo harapin, and alam mo rin, pati ang magiging anak mo. Sa future, kung biglang may sumulpot sa pinto ninyo, huwag ka na magtaka. Or sa future (knock on wood), if ever sa wake ng hubby mo, may susulpot na anak, at least ready ka na what to do or your kids, in case it happens lang naman. 

Ako kasi I have planned for it, kung sakali mamatay ang asawa ko, alam kong marami susulpot na anak sa labas, talagang magh-hire ako ng security not to let them in.  Yes kontrabida ang dating. But at that time, kasi galit ako.  At alam kong legal wife ako, at alam ko, yung mga kalaguyo nya alam na may asawa sya and yet intentionally nagpabuntis para may kapit sa kanya. Pero ang asawa ko ang ultimate demonyo for doing this to all of us.  But then, when things have unfolded, I decided to just leave. Kasi hindi ko kaya dalhin iyan burden na iyan habang nabubuhay ako, preparing for his wake and wishing him dead. Bad di ba?  So I left, I tried healing myself.  I let go. Ngayon, masakit tuwing naalala ko, but I have let go.  Kahit pa querida nya or number 3 nya magprepare ng wake nya kung mamatay sya, ok nako. Sila nalang bahala.

My reaction: good for the kid! Good for your husband's ex kabit. Good for you! Wala akong nakikitang mali sa gagawin nilang ipetition yung anak sa labas. They (exkabit and her child) are gonna be out of your life na talaga kasi hindi mo na sila makikita. I don't think din na hahabol pa sila ng child support, based sa sinabi mo na baka humabol pa kasi ngayon your husband's giving you a good life, dahil nasa Australia na sila. May means sya pumunta dun at manirahan dun. Hindi naman ata common yung galing sa Pinas yung padala diba. At kung secretly ipetition din ang asawa mo, pano nya mgagawa yun eh annulled na sila and ikaw n nagsabi na mahal ka ng asawa mo hindi ka naman nya siguro iiwan. I don't see anything she could do with your husband's passport and DL other than proof of parentage for their child. Check mo sa immigration laws ng Australia, kung yun nga talaga ang kailangan I say go for it! The sooner the better.

About sa mga comments na hindi mo nagustuhan. Minsan talaga nakakaoffend na pagsabihan ka ng mga hindi mo naman kilala pero ano magagawa mo, humingi ka ng opinion nh iba sa isang public site. We don't know you kaya kahit anong sabihin namin pwede and vice versa. Wag mo dibdibin. Focus ka sa issue mo. Wala naman sigurong hampaslupa dito na nagcocomment lang para mang inis. Everyone has their own way of voicing out. Goodluck sayo!

Its best to check the Australia Embassy Website to answer your queries and to avoid hearing things you dont want to hear.

Or magpost ka dun sa www.pinoykiwi.co at madaming sasagot dun sa'yo.
