Better consult an actual lawyer for this matter... my take is, it may be plausible pero baka meron nang underlying or pre-existing condition yung victim that may have actually led to his death in the first place at nataong naka-OT sya during the time of his/her death. Remember, some HMO's don't actually cover that. Performing an OT MAY have been one of the contributing or triggering factors pero not necessarily the main cause of death - only an autopsy can prove this.

Magiging questionable din kasi yung lifestyle habits  ng victim so this can be a very tricky case to bring to your counsel. Again, consult an actual lawyer and NOT some "saul goodman" -type.

Can I up this thread? because I think it can be the employee's lack of time management as well? Though of course if you work in a call center there would be mandatory ot's but if it's an ordinary office I think the employee has a fault to that part it's her prerogative if mag oovertime sya right? why sue the company for that?
