^pwede kasing void from the start eh... kasi nga walang marriage license... eh Art 34,  di pwede kasi di pa naman kayo nagsasama ng 5 years sabi mo nga...

^ yun nga sis eh. puwede ko kaya itanong dun sa city hall kung san kami kinasal?
busy pa naman si mama these past few days eh gusto malaman ng Papa ko sa states kung talaga bang legal marriage namin, kelangan kong alamin. pero sis the fact that I can get a copy of our marriage cert sa NSO, ibig bang sabihin kahit ganun puwede parin siyang maging void dahil sa mga conditions na yun?  :-\

Ang alam ko kapag meron kang nakukuha from NSO valid na yon eh, kasi naifile na sa kanila on ibig sabihin, dumaan na sa proseso, hindi ba? Dun nga nalalaman ng iba na fake yung kasal kapag hindi nakakuha sa NSO.

Check mo sa marriage certificate niyo kung sino at ano yung solemnizing officer na pumirma doon at saan din daw ba nangyari ang kasal.  May entries dun for these. 

Kelan ba kayo kinasal?  Noong last quarter of 2007, naglabas ng guidelines ang Supreme Court.  Minimal lang ang fees na hinihingi sa mga magpapakasal.  300 pesos lang yata.  Bawal ang humingi ng iba pang fees.  Very strict din ang mga huwes sa mga requirements bago magkasal ng couples.

Uulitin ko sis ha baka hindi tayo nagkaintindihan.  Kung void ang kasal mo kailangan mo pa rin magfile ng petition for declaration of nullity of marriage.  You still need the court to declare your marriage null and void.  Kung hindi, legally married pa rin kayo ng asawa mo.

Hindi ibig sabihin dahil may marriage contract na narehistro sa local civil registry/NSO, valid na yung kasal.  Ibig lang sabihin noon may record sila ng kasal.  Although there is a presumption that the marriage is valid, pwede pa ring mapatunayan na void nga.  Kaya halimbawa kung kinasal ulit ang isang tao na hindi pa napawalang bisa yung una niyang kasal, pwedeng may dalawa siyang marriage certificates na narehistro pero hindi ibig sabihin na yung pangalawang kasal niya valid.  May kopya nga ng marriage certificate sa LCR/NSO pero void yung 2nd marriage.

Hindi rin ibig sabihin na dahil hindi narehistro yung marriage  sa LCR/NSO, hindi valid yung kasal or wala nang kasal na nangyari.  Pwede kasing kinasal kayo pero nakaligtaan ifile yung marriage contract sa LCR.  Valid ang kasal pero wala nga lang record.

June 5, 2009 kami kinasal, sa Munisipyo ng Las Pinas. Lam ko we had to pay 3K+.
Magpapadeliver ako sis ng orig copy of my marriage cert from NSO para clear ko makia, kasi yung xeroxed copy that I have ang labo, di ko maintindihan.

I will keep you posted sis.

may license pero  ayun nga halimbawa kinasal sa manila city hall pero ang nakalagay sa marriage cert  san juan city?

ask ko rin po kung VALID 2?

^^^IMHO the marriage is valid.  As long as the essential and formal requisites of a valid marriage enshrined in the Family Code of the Philippines are present, the marriage is valid.

Art. 2. No marriage shall be valid, unless these essential requisites are present:
(1) Legal capacity of the contracting parties who must be a male and a female; and
(2) Consent freely given in the presence of the solemnizing officer.
(53a)
 
Art. 3. The formal requisites of marriage are:(1) Authority of the solemnizing officer;
(2) A valid marriage license except in the cases provided for in Chapter 2 of thisTitle; and(3) A marriage ceremony which takes place with the appearance of the contractingparties before the solemnizing officer and their personal declaration that they takeeach other as husband and wife in the presence of not less than two witnesses of legal age.

Art. 4. The absence of any of the essential or formal requisites shall render the marriage void
ab initio
, except as stated in Article 35 (2).
A defect in any of the essential requisites shall not affect the validity of the marriage but theparty or parties responsible for the irregularity shall be civilly, criminally andadministratively liable.

yes valid ang marriage even without marriage license. if no marriage license was issued under article 34, yung proof, mag eexecute kayo ng affidavit of cohabitation for five years prior to the marriage. pro forma na yan sa city hall.  pero dapat kinasal kayo at least age 23 kayong dalawa para magapply sa inyo ang article 34. pag less than 23, void yan. grabe talaga dyan sa pasay. me nakita ako marriage certificate ang date ng marriage license was sunday. obviously fake. when we tried to get a copy pinalitan nila yung date.

hi sis, sa case ko, we didn't have to execute an affidavit of cohabitation, not unless my MIL did it behind my back! I was 24yrs old na so right age na ako..pero wala talaga akong nakitang affidavit na un

i just want to confirm cause i have read an article that says that anyone who fakes that affidavit will be "criminally liable". I know a couple who used that affidavit saying they're living together na for 5 years but the girl was only 21 during the date of marriage. is the marriage automatically null and void? also, may penalty ba sila or makukulong dahil nagsign sila sa document na yun though hindi naman talaga sila naglive in?

just got my Solo Parent ID last week and had a free consultation narin with a lawyer regarding my case

I asked kung valid ba marriage namin or pwede ba ma-void kasi nga I don't have a marriage license plus the fact na nakalagay ako sa Art. 34 which means I have been living with my ex for 5yrs (which is not true). He said valid iyan but you cannot void it even if it is not true na 5yrs kayo nagsama kasi anjan na yung evidence sa marriage certificate that you signed and agreed to it :( whether you knew it that time or not, doesn't matter anymore, kasi I signed it :(

So erased na itong potential na dahilan ko sana for me to have the marriage void :(
Annulment nalang talaga katapat nito backed-up with the abuse I experienced..

The marriage is not null and void without prejudice that a case might be filed to the persons responsible.
Huwag na lang siya mag worry, wala naman siguro magrereklamo.

So, kahit walang marriage license at may NSO records na ng marriage certificate, it means that the marriage is legal, is that right?
May kakilala ako, ikinasal sila sa Office of the Marriage Minister, naka-tick yung box na "No marriage license was necessary, the marriage being solemnized under Art 34fc of Executive Order No. 209."
Tinatanong niya kung valid daw ba yung civil wedding nila? Sabi ko, siyempre valid yun...
Sakaling walang marriage license, tapos kakakasal lang, ipapasa nung solemnizing officer yung marriage certificate sa NSO, may proseso pa ba ang NSO na icheck kung valid yung ni-lodge na marriage certificate?
Kelangan ba nilang icheck kung yung dalawang parties eh talagang hindi kasal kanino man before that marriage bago nila ilagay yung record ng Marriage Certificate?

Subukan niyo gayahin yung rason ni kris aquino para mawalang bisa kasal niya.  Solemnizing officer yata ang dahilan na ginamit nila.

we also got married without a marriage license and i have been looking into this as a ground for annulment. my friend who is going through an annulment right now, spoke to his lawyer about my case. the lawyer said that my spouse and i could be held legally liable for getting married without a license and faking the "5 year cohabitation achuchuchu". It was my spouse's madrasta who arranged the wedding with a so called rev.

anyway, the lawyer said that, to be safe, it is still better to use psychological incapacity.

di ko pa nasabi din sa lawyer nia about sa solemnizing officer. nakita ko kasi sa marriage cert naman na yung solemnizing officer naman ay isang REVEREND ng isang denomination na hindi naman kami both member.
