Title: TIN problem, and taxes witheld

hi sisses! i hope someone here can can help me.

here's the story, I was an employee of a bpo company from march2008-june09
now, since they are my 1st employer isnt it that they are the ones who will
get me a TIN from the BIR? besides they asked me to fill-up an application form
and asked for my dependent's birth certificates.

I separated with them this June of '09 and when I was given my BIR FORM 2316
or computation of taxes withheld for the year of '08 my TIN there was "0"
If I dont have a TIN then it simply means that they are not remitting the taxes
they held from

Now, I'm currently employed with Shell Shared Services Asia, and they asked me to
fill-up another application form from the BIR, when I called BIR this
morning they advised me that I didnt have a TIN from my previous employer.

the big question is where are they putting the taxes held from my pay?
they gave me a tax reimbursement for Jan. '09 but still it's not
equal to the total of taxes witheld.

what are the proper steps to take so I can get reimbursed correctly?

^oh my. ako kasi, i got my own TIN number. anyway, have u approached your previous HR? ask mo what happened to the taxes that they were remitting for you?

they gave me a TIN but when i double checked the TIN my prev employer gave me they BIR said that it's not under my name!

i dont know what to do na., I'm still waiting for my separation pay so hindi ko pa sila maaway.,

what if they're remitting my taxes under another person's name since yung TIN ko on file sa kanila under a diff name.

may tax refund next year, I was advised na kapag hindi ko naayos to I'll have to pay BIR for the taxes not remitted under my name for Jan '09 - June'09

^that's sooo weird. TIN is not under your name? hrmm! could it have been an honest mistake on the part of your HR? anyway, o nga, wag mo muna awayin since may inaantay ka pa from them. is it a big BPO company? but first things first, let them know na hindi nakapangalan sayo TIN number na yun. baka ma-trace nila saan nagkamali.

check mo kung may withholding taxes, malamang meron.. you still need to file and pay your income tax on or before april 15

i also have a problem regarding taxes. is it possible to verify if the company is really remitting your taxes? i have worked for three years and i have only received one itr (not sure if its form 1601e) with no bank or bir stamp confirming that they have received my tax payments.

then your employer will issue you bir form 2316 which is a certification of compensation payment/tax withheld. this is signed by the authorized signatory of your company and is not stamped received by bir

the company submits bir form # 1604cf or known as the alpha list to the bir. this is a summariy of all bir remittances of your compensation

you can verify this in the bir. you may check the bir rdo of your company for easy verification

Question: Taxable ba ang Perfect Attendance Bonus? How about food and transportation allowance?

Generally, all income, whether in the form of salaries, bonuses and allowances, are taxable.  There are exceptions, such as those enumerated in the Tax Code and BIR revenue regulations.  Among the exceptions are de minimis benefits.  Also, reimbursements for expenses incurred for and on behalf of the employer, are not taxable.

In my opinion, the perfect attendance bonus is taxable.  The food and transportation allowance are considered as de minimis benefits and thus, not subject to tax.

This is happening to me too, Ive been employed with Cdr-king and since sila ang una kong employer dapat sila ang kukuha ng TIN ko. But then nung nagresign na ako sa kanila and lumipat sa ibang company, my current company is asking for my TIN. So I called cdrking and told me I have no TIN yet. Eh san kaya nila dinala lahat ng kinaltas nila sa akin?! now they are offering me to get me a TIN. So I just told them na yung current employer ko na lang kukuha ng TIN ko.

^ Make sure that your current employer will secure your TIN for you.  Ask for your TIN number and check it with BIR kung yun talaga ang TIN number mo.  Or better yet, get your TIN yourself.  You have to allot 1 day though to process this.

hi sis marose17, ask ko lang po if yung Total Amount of taxes witheld as adjusted sa 2316 form is yung total ng binayaran ng company sa BIR? Kasi i resigned in my previous company last feb, then i got into my new work last march.. i had my salary from jan and feb from my previous company (hindi sinama ang feb salary ko sa aking backpay, nakuha ko siya on that month;so less na ng tax yun) and also had my salary na sa new company ko last march..so technically, diredirecho ang pagkaltas saken ng tax kahit na lumipat ako ng company..now, i got my 2316 for months jan and feb 2011 and napansin ko na yung taxes witheld as adjusted is super liit, compared sa tax ko talaga.. i am worried na maliit lang talaga ang binigay ng previous company ko sa BIR and in turn, madededuct yung kulang sa salary ko ngayon in my new work. I already received my backpay, and i do not know kung sinama nila dun yung some part ng tax ko or whatever, medyo magulo din kasi yung breakdown ng final pay ko. please help sis, thanks in advance.

^ As far as I know, walang photo ang TIN ID, unless nagbago na ang itsura.

If you need a government-issued ID, you can present your passport, driver's license, SSS ID.

thanks sis, ang problema kasi wala ako ni isa man lang ID sa mga nabanggit mo pa in process pa lahat e mag aapply ako ng passport, company ID lang meron ako sa ngayon.. nag update kasi ako ng status at palit ng name.

^ Was your business on a net income position?  Hindi ba kamo lugi ang business?  Baka naman walang income na masa-subject to tax to begin with?  But, you may have VAT and withholding tax liabilities.

Yung TIN, forever na iyan.  You should not get a new TIN.  Having two TINs is a criminal offense subject to imprisonment and penalties.

Consult an accountant para ma-settle mo kung may tax due ka from the business. 

And next time, secure a separate TIN for your business.  Mag-incorporate ka na lang ng family corporation para iba ang TIN sa negosyo.

haay, ganyan din problem ng husband ko...he registered a business in 2009 but did not operate kase nagkaproblema with his partner...at ngayon nag update ang BIR meron daw liability si husband na 7k from 2009-2011, juice me! wala naman operation eversince!

oh well, lesson learned: dapat pala magfile din ng closure sa BIR in case wala na talaga yung business...

Yan kasi ang problema sa mga nagreregister ng single proprietorship. Pag hindi na nagwork ang business, pinapabayaan na lang. Hindi naiiisip ang implication later on. Once na naka-register ka sa BIR, tuloy-tuloy na yan. Kung walang operation, still dapat nagsa-submit pa rin ng mga monthly at yearly tax returns na may nakalagay na "no operation." Ipapa-receive lang naman yun sa BIR. Kung talagang wala ng pag-asa ang business, ipa-close ng maayos.

Computerized na kasi syempre ang BIR ngayon. So makikita at makikita talaga sa records kung may tax liability ang isang tao.

I would suggest na kung hindi naman ganun kalaki ang amount, i-settle na lang sa BIR. No choice ka rin naman kasi forever na may record ka sa BIR kung hindi mo aayusin. Kung medyo malaki ang amount, makipag-compromise na lang sa mga tao sa loob kung me papayag (although this is illegal).

@mhaevick, actually 30% ang income tax on corporations, 32% on individuals.  Sa corporations, puwede mo pang i-deduct from the taxable income ang ordinary and necessary business expenses.

ako din, magtatanong. i work as a freelance writer for a PR agency based  in pasig. yung payment ko, per article yun. so in a month's time, iba iba ang nakukuha, depende sa dami or konti na naisulat. sabi sa akin ng hr sa office, they deduct 5% withholding tax sa payment. ang tanong ko, kelangan ko bang magfile ng tax at pano ko gagawin  hindi naman fix yung income ko.

hi mga sis!

i was talking to a friend of mine last time and she told me na pwedeng lumiit ang taxes if may loan ka (in my case, may housing loan ako). is that true?

i asked my company pero di rin nila alam ang tungkol dito. have any of you heard about this before? :)

syempre laking ginhawa rin yan if pwede mabawasan ang tax. my monthly amortizations are killing my finances! hehe

thanks sis!  pero tanong ko, how do i compute. i don't have a receipt din naman from the PR agency. they deposit payment sa bank account ko. tapos yun nga, hindi sya fix. like may months na hindi ako naswesweldohan, pag walang pinapagawa.

@princessC, are you an employee?  If so, you cannot deduct the loan.  The only deductions allowed are the mandatory deductions under Section 35 (personal exemption) of the Tax Code, as amended.

@scrapbookjunkie, you have to calculate by back-tracking the deposits made by the PR agency to your account, i-total mo yun so that you will arrive at your annual gross income.  Then, from the gross income, deduct yung taxes withheld (yung 5%) by the company to arrive at your net taxable income

Actually, kapag nakita mo na ang ITR form, maco-compute mo naman doon ang tax due mo eh.  It's fairly simple.  Just read the formula and guidelines sa likod.  You may download it from the BIR website.
You may also go to your revenue district office at magpatulong ka mag-compute ng tax due mo doon sa officer-of-the-day.

^ You can read Revenue Regulations No. 2-98 and its amendments.

Please note that the withholding tax, regardless of the rate, is just an advance payment of the income tax due on your income.  Thus, your income tax payable depends on the graduated rates (5%-32%) under Section 24, Tax Code.

What exactly is the nature of your consultancy?

Hello mga sis! May BIR form 1904 at TIN card akong hawak, pero hindi ako yung naglakad nun. Sa Makati siya niregister pero magwowork ako sa Paranaque. Kelangan ko pa bang ipatransfer yung location? At anong gagawin ko dun sa BIR form 1904 ko? Thanks!

^sis ano ang 1904? Kasi kung change RDO ka ( from Makati to Paranaque ), 1905 ang form.
Punta ka muna sa current RDO mo then papatatakan mo iyon ( change RDO), then dadalhin mo naman sa new RDO mo, pero kapag employed ka yata, ipapasa mo nalang sa HR ninyo.

sis question lang, pwede bang iba ang magpasa ng FORM 1905 tsaka 1901 ko? Thank you.

I gave birth ng Sept, tapos nagfile ako ng change status ng Nov. Nung dumating tax refund namin ng Feb, wala akong 25k na exemption for my dependent kasi hindi daw umabot yung change of status ko. Meron kayang kasalanan yung company ko dito or hindi na lang talaga umabot?


Kasi nagtataka ako, nung kinukuha ko yung 2316 ko, pinaghintay pa ako ng ilang oras, kasi naghihintay pa daw sila(actually someone from Finance)ng signal go from our Main Office. I waited for 2-3 hours para lang irelease nila, samantalang hawak na nila, and to think na kasama ko pa ang baby ko sa office para kunin yun. Hindi ko lang talaga maintindihan kung bakit ganun. At isa pa, I believe, 2316 e dapat talaga binibigay yun, pero sa amin, hindi binibigay kung hindi mo nirerequest.

Hi mga sis, I also have a question.  What is the correct tax rate for project-based employee?  I am working now as sort of consultant sa isang local company, but my contract says I am project-based and my tenure is co-terminous with the project we just launched. My tax is graduated tax ba yun? Yung based sa tax table.  Is that correct? Kase I am being paid hourly based on my prescence sa site, so I feel medyo weird being taxed this much.

Hope someone can help me on this. :)

^ako sis consultant. Pinakuha ako ng DTI Certificate and BIR Certification of Registration para 2% ang ideduct nila sken then ako na magffile sa BIR ng 3% tax.

QUESTION:
if you had more than 1 employer, say 2 employers, in 1 calendar year,
you are disqualified for substitute filing, meaning you need to file for your ITR,
by consolidating your 2 itr from 2 companies, on your own,
#1-how do you do that?
#2-what happens if you don't/forgot to do it?

I have a problem, ngayon lang nasabi ng HR sa kin na mali yung tax number ko. Yung tax number ko pala isa yung tax number ng 1st company ko pa. Pano nangyari yun? eh nakakareceive naman ako ng ITR? mapepenalty pa ko for this? please help.

^ You can only have one TIN.  Hindi ka puwedeng magpapalit-palit ng TIN when you move from one company to another.

It is different though if you are using the TIN of your previous company, hindi yung TIN mo mismo.  Please clarify kasi hindi malinaw ang tanong mo.

Yung tin number ko daw na gamit is TIN no ng 1st company ko. Eto na yung ginamit ko ever since eto kasi yung nakalagay dun sa ID ko sa company ko wayback. Ngayon nagpa update ako ng status ko kasi kapapanganak ko lang last Januray. Sabi ng HR hindi daw yun yung TIN no ko, binigay nila sa kin yung totoo kong TIN no. My question is pano yung mga nahulog na tax dun sa akala kong TIN no ko? na hindi pala? mapepenalty ba 'ko?

^ As I have stated, a person can only have one TIN.  It is a criminal offense to have two TIN numbers.  Thus, your first TIN should be your TIN.

Your present company should not have gotten you a new TIN because you do not have to change your TIN each time you transfer to another company.

I suggest I-clarify mo sa HR ninyo kung ano ang basis nila para sabihin na hindi totoo ang previous TIN mo.  Baka naman hindi pala sa iyo nakapangalan yung TIN mo from your previous company.

Paano po ba gumawa ng BIR 2316..para pirma nalang ng hr..nalilito ako sa mga numbers e..baka may sample kayo for 20k gross income?

Hi! question po re incorrect TIN. Nagtrabaho po ako sa Bulacan from June 2005 to Oct 2006. Then nagwork ako sa isang BPO company sa Libis from Sept 2007 to Aug 2014. Currently, employed po ako sa ibang BPO company sa Mandaluyong. HR asked me na magpatransfer ng RDO. So, I went to RDO in Quezon Ave. kasi sila ang nagcocover sa Libis area with my Form 1905. I used my TIN na nasa ID ko from previous company. Sabi nila that TIN is for a different taxpayor and kelangan ko pumunta sa RDO in Bulacan para sa transfer. Then I checked yung form na binibigay ng prev comp ko (yung nasa Libis) every year. It has a different TIN. Sabi ng BIR yung TIN na nasa form na binigay ng prev company ko is invalid.

What should I do para ma-update ang account ko with the payments made if there is any? TIA

Hi mga sis.

Ako naman po mali yun TIN type. Professional po nakalagay kasi nag apply daw po ako ng TIN online way back 2004. Ang dapat employed. E ang alam ko po yun first company ko po ang nagprocess ng TIN application ko since first job ko siya.  Ang sabi po sa akin ng BIR gawa daw po ako ng letter tapos saka nila ichecheck. Kasi po namomoblema ako pinagbabayad ako ng fine almost 39k dahil professional daw po ako since 2004 e never naman ako nagwork ng hindi company.

Haay sana po maayos ko ito.  God bless.

Ganun na ba ngayon- yung first company mo magpa-process ng TIN mo?

I applied for my TIN when I was 18, working student kasi ako. I forgot how I did it pero alam ko ako yung nagprocess. Online ata yun. And then nagrequest ako ng TIN ID sa BIR office mismo. Although it?s not considered a valid ID. Gusto ko pa din may ID.

Anyways, yes important 1 lang yung TIN mo. Once you have your TIN, write it down along with your SSS/ Philhealth, PagIbig & Passport Numbers. Para easy access in case you need them.

^ dont worry, you wont pay the fine theyre asking you. Walang nakukulong basta employee ka, ayusin mo lang sa BIR mismo and give what they need. Alam naman nila yan nangyayari talaga yan for employees.

Ang issue ko naman before di ako nagpalit ng RDO when I changed companies.  Sabi ng prof lawyer ko walang issue dun as long as inform lang si BIR like personal appearance for correction soon as you realised your mistake.
