To those who want to resign, just have the courtesy siguro.  For sure your employer will understand.  Sabi nga ni sis "aquacharly", when you applied lahat willing kayo gawin, legally to get that post.  In turn, when you resign, dapat sundin din natin yung tamang procedure.  If maiiwasan na biglaan na lang umalis, mas mabuti.

On the otherhand, if the reasons are very compelling naman, like sobrang ganda ng opportunity or talagang kailangang umalis, technically, unless may pinirmahan kayo "non-competition clause" if you intend to transfer to another company which offers the same services or in line with the same business, walang magagawa ang employer ninyo because the Constitution guarantees it, I mean bawal ang force labor.  Di ka pipiliting magtrabaho, kung ayaw mo na talaga.

sissies, what if  1 day pa lang sa work, no contracts signed, do i need to tender a resignation letter? or  a verbal resigntion may do? what's the best process ng pag reresign in my case?  :(
hope you could help me asap, coz i'm going to let them know tomorrow..

Doon sa 2nd company ko sobrang diyahe since halos freshgrad pa ako nun. Matindi ang pulitika, personalan at chismis sa akin nung hr at pati narin bosses since couple couple ang management. Nagpasa parin naman ako ng resignation pero nagaway pa kami nung balahurang hr namin na asawa ng boss ko kaya di na ako nagpakita for the notice period. So di ko na rin kinuha last pay, abuloy ko nalang sa kanila. Wala na rin naman akong iturnover dahil rolled off na ako doon sa project. The funny thing is since meron silang shareholder na lawyer, siya ginamit nila to send me a demand letter. Siyempre nastress kami ng family ko to the point na I went to lawyers to seek legal counsel, DOLE tsaka may isa pa eh. Sa DOLE tsaka yung isang ahensiya ng pamahalaaan walang kwenta pinagsasabi, ako pa sinasabing mali. Ending is know your rights. Yung contract ko kasi with them has a bond worth 700k if I remember correctly for the trainings etc. Eh wala namang trainings maski certifications tas for probis lang yun eh since close to 1 yr na ako wala na siyang effect. Tsaka maraming misleading clauses so kahit magkademandahan pa mananalo parin ako. Yung contract din nila is copy paste from their previous company na pinagtrabahuhan nila prior to building their own. So parang ginaya lang nila yung ginawa sa kanila nung previous employer nila. Adik lang diba? Ngayon so far okay naman na ako. Hassle lang yung pagaapply ko noon especially pag may background checking tas yung lintek na hr ang nakakasagot. Sinisiraan kami. Hayzzz. Buti natabunan nang ibang employers ko sila. sis... dapat kasi nag notice ka pa din. kasi if it's required it's in the labor code that you should render atleast 15-30 days miski wala ka ng ituturnover :) tama naman na know your rights (like sa case mo sa bond) but it's also proper to observe the correct # of days for notice since it's in the labor code of the philippines saka syempre pag nag background check kasi part ng professionalism mo eh yung pag render so baka bigyan ka ng negative feedback for not rendering :)

i resigned through phone, then they accept it. they will inform me na lang daw if may dapat pa isubmit w/c is yung RL, weeks after pero di na naman nila ako kinontak. so i guess it ends there. i actually think of abandonment of work na lang gawin ko as in awol then di ko na sila iiinform ever, but i realized, this is such a small world so if i did that and our path meets, mas nakakahiya.

@sweetyashie: Of course familiar ako doon. And nasa Labor Code din na you cannot humiliate & insult an employee. Degrading one's moral is a big no no. Besides din rin naman nila nireremit benefits namin nun. Niremit lang nung may nagsampa ng kaso sa kanila at nanalo. Issues are a case to case basis kaya nga sabi ko know your rights dahil kapag wala kang kaalam-alam yung mga mapanglamang na company they can do things beyond words kahit labag na sa batas.

may thread pala na ganito. :) sis, anung loans po ba yung tinutukoy mo? lahat po ng loans dinededuct sa last pay (this includes, last salary, monetary incentives, benefits convertible to cash etc.).

dati, hindi sinasama ang government loans sa final pay deduction. pero dahil madaming nagiging delinquient payers, ang pagkaalam ko mandatory na for companies na deduct yung government loans from your final pay. :)

kapag nacompute na lahat at negative balance ka, meaning, kulang ang final pay mo to compensate for the balances you have with the company (like loans, bonds etc, overused sl/vl), makakapagresign ka pa rin po from the company.

However, maaring hindi mo makukuha yung mga company documents na need mo, like clearance, COE, ITR. it can be withheld by the company until you are able to settle your outstanding items with them. :(

company loan sis at cooperative loans. wala ako loans sa government like sss. and I'm not going to work again after ko sana magresign.  I want to focus taking care of my son.

@sis sweetsorrow - sis just a suggestion. :) you may want to talk to your HR regarding your resignation and your loans. they would not be able to give you yung amount ng final pay mo para macheck kung mababayaran mo yung mga loans mo. pero pwede mo sila makausap on what options they can offer if hindi kayang mabayaran ng final pay mo yung mga loans mo.  ;)

sayang naman kase kung matarnish ang reputations mo sa coop at sa kung saan ka man nagloan. you may also want to get contact numbers kung san ka nagloan. puwede mo itry ituloy yung pagbabayad ng loan sa kanila kahit di ka na connected with the company. :D personal transactions mo kung baga  8)

sa mga nagbabalak po magresign. basahin po natin ang ating mga notice period. :) kahit standard ang 30 days notice, ang magsupercede pa rin ay kung ano ang pinirmahan natin sa contract.

kung required po tayo magbigay ng notice pero kelangan na natin magsimula, mainam na kausapin natin ang ating employers. iwasan natin magAWOL, hindi kase maganda sa records natin bilang employado.

magtry tayo magbargain kung saan masaya ka, masaya si employer at si bagong employer para smooth ang transition. :)
