Do I need to pay homeowners association dues kahit di pa nakatira sa subd?

Hi, just want to ask for your help. We have a property in a subdivision in Cavite. Naturn over na last 2006 pa, pero the keys are still at the office. Hindi pa kami tumitira dun, it was just a gift from our parents pero we work in QC kaya nalalayuan kami. Tapos nagkaroon ng homeowners association sa Phase 2 where our property is located. Nagkaroon ng association fees at kasali kami, now we just got a letter from a law office that we have unpaid dues from their client.

Do we have to pay their association dues kahit di pa kami nakatira dun?

Section 5. Rights and Duties of Every Homeowner. - Every homeowner has the right to enjoy the basic community services and facilities: Provided, That he/she pays the necessary fees and other pertinent charges.

^thanks! So does this mean na I'm not obliged to pay the association fees since I'm still not residing in the subd?

To make it simple, yes, you have to pay.  One of the basic services the dues covers is security.  Kahit wala ka doon sa bahay mo, binabantayan pa rin sya ng security guard.  Another would be the maintenance of the road/street in the subdivision.  There are other stuff to consider but bottom line is, whether you are present or not, the existence of your house or lot (in some cases) will cost a certain amount for direct or indirect services rendered by the Homeowners Assoc.  Siguro you can talk with the officers of the assoc. and request for discounts.  Hindi naman bawal yun and who knows baka talagang mababait din yung mga future neighbors mo.

just wondering, same case din ba if lot palang? My uncle plans to build his house dun sa subdivision but provided bayaran nla ang homeowners assoc fee amounting to 150,000 already. Ayaw sila payagan mgpagawa unless na settle ang amount na to... legal ba un?
