May business po ako tapos my dti at bir rin ako every month ngbabayad ako ng monthly percentage tax ang problema ko ngayon [textspeak!] akong bookeper tapos hindi ako ngfile ng itr. Ano po kaya ang mangyayari sa business ko? Malaki po ba ang penalty? T.i.a!

di ako masyadong marunong sa ganyan sis pero from what i know mejo malaki ang penalty for late filing. kami nga nagkaproblem naman sa accountant so di rin kami nakafile last monday... go to your bir office as soon as possible na lang sis and depending on the size of your company siguro prepare at least 5k sa penalty... pwede rin naman tawag ka muna sa bir niyo tapos inquire ka as anonymous para you can get more info :) mas matagal mo mafile sis mas lalaki ang bayad

hi Sis yun penalty is depende sa gross sales mo usually dun nila compute yun penalties and surcharges + the compromise for single prop usually P1K yun compromise pero depende pa din sa RDO minsan mas malaki.

 Pero pano po yun kung wala akong bookeper at accountant maliit lang kasi ang business ko tapos wala akong ka kaalam alam na may ganun pa pala kasi akala ko oky na yung every month na nagbabayad ako Ng monthly percentage returns.  :( ang daming rekubitos pala. Hayzzzz
Na stress na ako sa kakaisip ng ganito [textspeak!] [textspeak!] ako mahingan ng advise tungkol dito tapos kng sa bir naman ako mgtanong susungitan lang ako.... >:(
Tama ba to every day yong kita ko 5000x3% vat = 150pesos x30days 4500 [textspeak!] bnabayaran ko sa bir.

OMG! Hindi lhat naka OR kasi minsan lAng ako nagbibigay ng reciept....huhuhu yung benta ko nililista ko [textspeak!] sa journal tapos doon ko binabase ang binabayad ko everymonth. Hala paano kaya to kahit mga expenses ko hindi na nakalista parang nenerbyos na ako baka subrang laki ng penalty ko.  :-[

^ hi sis , yes tama yun steps mo, after mo makuah yun dti reg mo diretso ka na sa barangay to get your brgy clearance ito [textspeak!] din ang dadalin mo sa cityhall to get your mayros permit, you also need to bring your contract of lease. Yun ibang requirements depende [textspeak!] sa municipality yun iba need pa ng location map and pictures others hindi na... after mo makuha yun business permit mo diretso ka na ng BIR for your registration you need to pay yun annual reg w/c is PhP500 and doc stamps for rent, pwede ka na din mag pa print ng SI at OR mo, dont forget to register na din your books :)

Re sa BIR i have personal TIN got from employment do i need to apply separately for business po ba?
And ano po yung books na need ko pa register????

Sensha na dami tanong first time kasi eh, nga pala sis once ba na wala ka pa ng permit the business can't be operational pa? Or pede na operate while processing the docs?

kailangan may permits kana before you start malaki kasi penalty if mahuli ka. you need kasi OR before mo makuha yun sa printing press complete kana dapat

RE: BIR TIN - kung may TIN ka na. yan na po yung TIN na gagamitin mo rin sa business mo. yung books yun yata yung columnar. papabilhin ka nun tapos tatatakan nila.

ako kasi naopen na ko habang nagpprocess na yung mga permit ko (soft opening) sabi bawal daw yun pero karamihan yun ang hehe

Matagal po ba ang processing ng permit??? parang natakot naman ako sa penalty if ever na mag operate me ng ala pang permit.

^ depende sa munisipyo. may mga clearance pa kasi yun (health/sanitary clearance, fire dept. clearance, etc... ) pag napapirmahan mo naman kagad yun, in 3 - 7 days after magbayad makukuha mo na permit and plaka mo.

Un bang 3% is for NON Vat? Pano ma determine na 3% lang ang tax versus the 12%?

Sabi kasi pag 550k ang gross annual income it is under non vat, from what i understand, ang kita a month is 45k and below para non vat?

^yes sis 3% percentage tax is for non-vat then pag vatable ka naman sales (output tax) less expenses (input tax) comes the 12% tax meaning output less input x 12% yan na yun babayran mo na tax... pag ang sales mo is 1.5M in a year automatic dapat vat ka na.... pero it depends on your registration pwede ka na din [textspeak!] mag vat kahit wala ka pa 1.5M sales para di ka na din magpa-amend ng COR mo once na ma reach mo yun 1.5M sales....

yun barangay clearance mo is kung saan located ang business mo... if you have tin na then nakuha mo from your employment papa transffer mo lang sa rdo kung nasaan ang business mo [textspeak!] di pwede na kunyari sa QC mo nakuha tin mo then sa makati ang business mo dapat transfer mo muna from qc to makati bago ka nila i allow ma reg ang business mo.... yun books naman is after your registration na dito mo isusulat lahat ng transaction mo sales, purchases at disbursements... pwede ka naman mag operate while processign the docs pero once na ma tax map may penalties na imposed dun kaya dapat talaga reg ka muna bago ka mag start ng business...

Lets say ABC GEN Merchandise, ABC Trading or ABC Enterprise. For me i want sana ABC Enterprise. but sabi ng napag ask ko hindi daw basta basta ganon. there are guidelines daw na fina follow para mag fall under gen. merchandise, trading or enterprise yung  store/shop.

All banks require a business permit/dti certificate for you to be able to loan in expanding your business. What if you have an online store and wants to register for this sake and also for legality. Since sa loob ng house lang naman un sine-sell if ever ba mag tax mapping ang bir magkaka pentalty or violation ka ba?

sobrang helpful ng thread na 'to. :)

i want to setup an online homebased business (single prop) na nakakapagissue ng receipts. wala akong office/space kasi employees are online (odesk, elance etc). i already have a TIN number. do you have an idea kung magkano ang gagastusin ko for the permits and licenses? And also, ganito ba ang computation ng 3% for 2551M bir return:

Gross Sales: P100,000
Tax Due for the Month: P3,000 (3% of gross)

Tapos yung annual income tax follows the usual tama ba?

i am in the gathering funds phase pa lang kasi and i need to take this into consideration. maliit lang ang business na gusto ko pero i really need to issue receipts kasi big companies ang prospective clients. di naman yun papayag ng wala.

i work as a accounting staff ng isang corporation so medyo gamay ko yung bir filing for corporations. sa single prop. lang talaga ako walang idea. tia!  :D

hi sis!  papano kung ang  TIN is registered in Pque now tapos may business na ilalagay sa Pasig.  Not necessarily the same line of business,  pwede pa rin kaya yun tawagin na "branch"  kase same TIN yung gagamitin nya?  and kailangan pa rin nya magtransfer ng RDO eh pano kung parehong existing yung businesses in 2 different cities ? i think based lang sa gross sales/income para masabing nonvat or vat.  pero from expreience, mas okay na VAT ang registration kase nabawas nyo na expenses nyo sa income before nacompute ang tax, di tulad ng percentage tax na laging sa gross kinocompute ang tax. 

regarding your question about gen merchandise, trading or enterprise,  isang malaking question din yan sa akin.  sa DTI kase namin,  our business name is ABC Enterprise as food retailer,  ngayon we have other small businesses like BPO and photobooth business,  we are not sure if pwede pa namin gamitin yang DTI trade name na yan or separate trade name na dapat.  Ayoko na sana kumuha separate tradename since enterprise is generic naman.
