After actress Katie Holmes filed for divorce from husband Tom Cruise in New York on June 28, Tom is now asking for the proceedings to continue in California as he believes that New York is not the proper place for the matters to proceed.
"Tom will file a response in New York, asking that the divorce proceedings be halted in the Big Apple because California is the proper venue for the matter to proceed," a source was quoted in a PEP.ph article. "Team Cruise is going to assert that Katie doesn't meet the residency requirements to file in New York, and that both live full time in California, specifically Los Angeles."
''Tom's lawyers will state in their response to Katie's divorce petition in New York that she didn't reside continuously in New York for a year, as the law states," the source continued. "Yes, they do have a home in New York, but Tom will argue that Los Angeles is where they live, period.''
Tom will also ask for joint custody of their six-year-old daughter Suri, despite Katie’s request that she gets sole custody of their child. "There is absolutely no way that he is going let Katie have sole custody," the source said. "The lines are being drawn, and this is going shape up to be a very contentious custody battle."
Tom and Katie married in November 2006, and despite Tom's claims that their little family is very happy, Katie is allegedly worried about raising Suri in the religion of Scientology, of which Tom is a follower. According to Hollywood news site TMZ.com, Katie filed for sole custody because she doesn’t want Tom controlling any of Suri's decisions when it comes to religion.
